AMENDMENT 19-004
REGARDING
THRESHOLD INCOME LEVEL FOR COMPREHENSIVE PREGNANCY
COVERAGE
Pursuant to 42 U.S.C. Section 1396a (a) (13) (1997) and 42 C.F.R. Section 447.205, the Department of Health and Human Resources (“Department”), Bureau for Medical Services (“BMS”) provides notice of the filing of a state plan amendment (SPA), identified as SPA 19-004, regarding the threshold income level for eligibility for comprehensive pregnancy coverage under West Virginia Medicaid. The SPA specifically makes changes the upper limit from 158{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the federal poverty level to 185{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}. This change is being made pursuant to Senate Bill 564, enacted during the 2019 regular legislative session.

This SPA will be made effective on July 1, 2019, or as soon as CMS approves the SPA, whichever occurs later. The expected approximate fiscal impact for fiscal year 2020 will be approximately $2.4 million (approximately $600,000 state dollars and $1.8 million federal dollars); the expected approximate fiscal impact for fiscal year 2021 will be the same.

The SPA and this notice will be available for public inspection in each county office of the Department of Health and Human Resources during normal business hours, 8:30 a.m. to 4:30 p.m., beginning Tuesday, May 7, 2019, through Friday, June 7, 2019 and on the web at: www.dhhr.wv.gov/bms, then click “Public Notices” on the top toolbar.
