NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated October 18, 2006, executed by the Borrower(s), Brenda K. Campbell and James A. Campbell, to Jeff Rokisky, the Trustee, of record in the Office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1511, at Page 251. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1589 Grafton Rd., Morgantown, WV 26508. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated October 21, 2024, of record in the Clerk’s Office in Book 2624, at Page 626. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:
January 21, 2025, at 5:32 p.m.
All of the following described real estate together with improvements and appurtenances thereof, situate, lying and being in the Clinton District, Monongalia County, West Virginia, and more particularly described as
follows:
PARCEL NO. 1: BEGINNING at a point on the right-of-way of what is known as U.S. Route 119, said line running in a northwesterly (incorrectly cited as northeasterly) direction along and with the right-of-way of U.S. Route 119, 149 feet to a corner; thence in a southeasterly (incorrectly cited as southwesterly) direction with the lands formerly owned by Howard Dalton a distance of 48 feet to a cross on a flat stone in the side of what is known as the Old Beverly Pike and then continuing to the center of said pike; thence along and in the center of said road in a southeasterly (incorrectly cited as southwesterly) direction 154 feet to a point in the center of said road; thence leaving said Old Beverly Pike in a northwesterly direction a distance of 48 feet, more or less, to the point and place of beginning, and containing one-fifth (1/5) acre, more or less.
PARCEL NO. 2: BEGINNING at a point in the center of what is better known as the Old Beverly Pike, said line running in a westerly direction on a line known as the Thomas Jeffers line a distance of 16-1/2` to the right-of-way of what is now known as U.S. Route 119; thence in a northwesterly direction along and with the right-of-way of said U.S. Route 119, 316.5` to a point in the line of Arthur B. Mace, Jr. one of the former Grantors herein, and his former wife, Ruth Ann Mace; thence with the line in a southeasterly direction 48` to a point in what is known as the Old Beverly Pike; thence again in a southeasterly direction 228.5` to the point and place of beginning.
THE above parcels of real estate were recently re-surveyed as shown and designated on a map or plat prepared by McCoy Land Surveying, dated March, 2000, attached hereto and made a part hereof for all pertinent purposes, and is more particularly bounded and described as follows:
BEGINNING at a 1/2 inch iron pin set on the northern right-of-way limits of U.S. Route 119 and corner to Lucky Piccalo; thence with one line of Piccalo, N. 28 degrees 42` 56″ E. 57.74 feet to a 1/2 inch iron pin set in the center, line of Old Beverly Pike; thence with said Pike for five lines, S. 72 degrees 57` 18″ E. 105.67 feet to a point; thence S. 54 degrees 17` 23″ E. 61.84 feet to a point; thence S. 47 degrees 07` 23″ E. 89.14 feet to a point; thence S. 50 degrees 38` 55″ E. 186.61 feet to a point; thence S. 34 degrees 48` 55″ E. 34.40 feet to a point on the northern right-of-way limits of U.S. Route 119; thence with said right-of-way, N. 61 degrees 17` 04″ W. 465.50 feet to the place of beginning, containing 0.53 acre, more or less.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code ยง 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
