TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 2, 2004, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, Document No. 1592721, in Book No. 1241, at Page 233, Julie A Loborec did convey unto Mitchell Lee Klein, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by THE BANK OF NEW YORK MELLON FKA THE BANK OF NEW YORK AS TRUSTEE FOR THE CERTIFICATE HOLDERS OF THE CWABS, INC., ASSET-BACKED CERTIFICATES, SERIES 2004-ECC2 to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 06 – Triadelphia Country District, Ohio County, West Virginia, and more particularly described as follows:
Parcel I:
Beginning at a point in the southerly line of Clifton Heights Boulevard, said point being the most northeasterly corner of a tract of land conveyed by Emma J. Folmar and Henry A. Folmar, her husband, to Melvin Folmar by Deed dated May 18th, 1925, and being recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 201, Page 30; said beginning point being also located S. 62 deg. 48′ E. 140.0 feet from the most northwesterly corner of a tract of land conveyed by George P. Folmar, et. al., to Emma J. Folmar, wife of Henry A. Folmar, by deed dated November 20, 1909, and being recorded in the aforesaid Clerk’s office in Deed Book 132, Page 533; thence with the said southerly line of Clifton Heights Boulevard, the following two courses and distances; S. 62 deg. 48′ E. 43.0 feet to a point and S. 77 deg. 05′ E. 132.72 feet to a point; thence leaving the said southerly line of Clifton Heights Boulevard, S. 30 deg. 01′ W. 165.63 feet to a point in the northerly line of the Cedar Rocks Road; thence with the said northerly line of the Cedar Rocks Road, N. 41 deg. 58′ W. 180.11 feet to a point; thence leaving the northerly line of Cedar Rocks Road and with an easterly line of the above mentioned property of Melvin Folmar, N. 31 deg. 15′ E. 68.80 feet to the place of beginning, Containing 0.443 acres more or less. Parcel II:
Beginning at the beginning of the third or S. 30 deg. 01′ W. 165.63 feet line of the lands conveyed by Emma J. Folmar, widow, and being recorded in the aforesaid Clerk’s Office in Deed Book 356, page 156; thence proceeding and binding on aforesaid third line S. 30 deg. 01′ W. 165.63 feet to it terminus, said terminus point being in the northerly line of Cedar Rocks Roads; thence with the northerly line of Cedar Rocks Road, S. 41 deg. 58′ E. 10.00 feet; thence for lines of division through the lands now owned or formerly owned by the Franklin Real Estate Company, a Pennsylvania Corporation, the following two courses and distances: (1) N. 48 deg. 42′ E. 100.00 feet and (2) N. 01 deg. 14′ E. 84.00 feet to the point of beginning containing 0.088 acres of land, more or less, according to a survey made July 5, 1958, by Maurice Henry Moore, Professional Engineer, State of Pennsylvania, Registration No. 4757-E.
There is excepted from the above-described real estate and not hereby conveyed, that portion of the above described real property conveyed by William M. Shepherd and Emma J. Shepherd, his wife, to Georgia Folmar Ossman, widow by Deed dated May 14, 1958, and recorded in the aforesaid County Clerk’s Office in Deed
Book 399, at page 104.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: RD 2 Box 313 AKA 83 Cedar Rocks Rd, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $4000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
