NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE
Pursuant to the authority vested in the undersigned by deed of trust dated the 1st day of August, 2012, signed by Stacy Lynn Cook, to Robert D. Lewis, Trustee, which said deed of trust is of record in the Office of the Clerk of the County Commission of Ohio, West Virginia, in Trust Deed Book 1440, at page 655, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 1:15 o’clock p.m. on the
28th DAY OF
JANUARY 2025
at the front doors of the Ohio Courthouse in Wheeling, West Virginia located at 1500 Chaplain Street, Wheeling, WV 26003, the following described real estate:
A certain parcel of land, situate upon the westerly side of United States Route 40, also known as National Road, located in the Liberty District of Ohio County, West Virginia, bounded and being more particularly described as follows:
Beginning at a point located in the said westerly side of National Road, in the run, at a corner common with the most southern corner of the 14.21 acre tract of land that was conveyed to George P. Folmar and Clara W. Folmar, his wife, by a Deed dated on the 31 st day of March, 1966, and recorded n the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book No. 472, at page 169.
Thence, from the said place of beginning, leaving National Road, and now with the lands of the said Folmar, N 49 deg 30′ W. for a distance of 500.01 feet to a set iron bar. Thence, with the same, N. 56 deg 38′ W. for a distance of 63.56 feet to a set iron bar. Thence, with the same, S 51 deg 40′ W. for a distance of 274.72 feet to a set iron bar. Thence, leaving the lands of the said 14.21 acre Folmar tract, S. 36 deg 47′ E. for a distance of 226.00 feet to a found iron pipe located at the westernmost corner of 45733 square feet parcel of land that was conveyed to Mark C. Richey and Lisa M. Richey, husband and wife, a by a Deed dated the 16th day of September, 1994, and of record in Deed Book No. 681, at page 730. Thence, with the same N 29 deg 30′ E. passing an iron bar set at the most northern corner of same at 108.00 feet for a total distance of 216.00 feet to a set iron bar located at the most northern corner of a 45733 square feet parcel of land that was conveyed to Don W. Hess, Sr. and Mary Catherine Hess, his and wife, and of record in Deed Book No. 738, at page 502. Thence, with the last mentioned parcel of land S 56 deg 08′ 30″ E. passing an iron bar set on line at 228.31 feet, for a total distance of 434.70 feet to a point located in the previously mentioned westerly side of National Road. Thence, with the same, N. 45 deg 10′ E. for a distance of 65.00 feet to the place of beginning, containing 2.036 acres, more or less, as the same was surveyed in the field in July, 2008, by Bryan A. Payne, West Virginia Registered Land Surveyor No. 977.
The party of the first part, for himself, his successors, heirs and assigns, excepts and reserves from this conveyance all oil and gas underlying the subject property together with the extraction rights thereto.
This Deed is subject to exceptions and reservations with respect to the coal underlying said land and the mining rights appertaining thereto and such other mineral rights as have heretofore been disposed of or conveyed.
This conveyance is subject to any and all exceptions, reservations, restrictions, conditions, covenants and easements as shown on all prior Deeds of conveyance or other instruments of record.
The Grantors have no actual knowledge or reason to believe that the property, including its substrata or subsurface, has been used to the storage, treatment or disposal of hazardous waste or that it contains or did contain any underground storage tanks.
It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust.

TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees.
Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder.
Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record. Some Trustee sales may be conducted by a servicer required Auction Company. In that event, the auctioneer will be acting under an “Auction Services Agreement.”
