NOTICE OF
TRUSTEE’S SALE

Pursuant to the authority vested in the undersigned J. Patrick Jones, Substitute Trustee by Notice of Substitution of Trustee which notice is of record in the Office of the Clerk of the County of Commission of Ohio County, West Virginia, and by Deed of Trust dated September 20, 2019, executed by Sean P. O’Brien to John E. Gompers, Trustee, which deed of trust is of record in the Office of the Clerk of Ohio County, West Virginia, in Trust Deed Book 1589 at Page 572, the undersigned Substitute Trustee has been requested, in writing, by the beneficiary of said deed of trust to sell the real estate described below, as there has been a default under the terms and conditions of said deed of trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust, at a public auction on February 27, 2025 at 1:00 p.m. to the highest bidder at the front door of the Courthouse of said County of Ohio, in Wheeling, West Virginia, which real estate is more completely described as follows:
The following described real property situate on the easterly side of Warden’s Run Road, Richland District, in Ohio County, West Virginia, more particularly bounded and described as follows
Beginning at a point at the most westerly corner of the 2 and 3,698/10,000 acre tract of land that was conveyed by Evelyn L. Jones and Lambert T. Jones, her husband, to Lambert T. Jones II by Deed recorded in the office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 601, at page 280, said iron pin also being in the easterly line of the 1 and 422/1000 acre tract of land (Section. One), that was conveyed by Evelyn L. Jones, wife of Lambert T. Jones, to Lambert T. Jones and Evelyn L. Jones, his wife, by Deed dated May 20, 1988, and recorded in said County Clerk’s office in Deed Book 645, at page 138; thence from said beginning point and with said 1 and 422/1000 acre tract N. 02″ 34′ W. 42 and 57/100 feet to an iron pin at the southwesterly corner of the 5 and 66/100 acre tract of land that was conveyed by Hilda Ida Louise Schenerlein and Harvey P. Schenerlein, her husband, to Harvey P. Schenerlein III by Deed dated September 1,1971, and recorded in said County Clerk’s office in Deed Book 527, at page 464; thence with same the following two (2) bearings and distances: N. 42 Degrees 14′ 40″ E. (passing iron pins at 101 and 34/100 feet, 245 and 87/100 feet, 332 and 16/100 feet arid 426 and 56/100 feet) 483 and 34/100 feet to an iron pin; thence N. 11′ 33′ W. 94 and 83/100 feet to an iron pin at the southwesterly corner of the 11 and 97/100 acre tract of land that was conveyed by Albert D. Depto, et ux, to John R. Felton, Jr., et ux, and James L. Brinsky, et ux, by Deed dated October 29,1998, and recorded in said County Clerk’s office in Deed Book 708, at page 611; thence with same N. 67′ 42′ E. 197 and 3/10 feet to a 24 inch locust tree at the northwesterly corner of the parcel of land that was conveyed to Kathleen P. Shultz and J.S. Shultz by Deed recorded in said County Clerk’s office in Deed Book 635, at page 69, said parcel being known as Lot 32, Bello Vedere; thence with the westerly line of Lots 32 through 40, Bello Vedere, the following three (3) bearings and distances: S. 55 Degrees 47′ E. 466 and 59/100 feet to an iron pin; thence S. 34 Degrees 18′ E. 220 and 22/100 feet to a point; thence S. 65* 23′ E. (at 475 and 73/100 feet passing the division line between Lot 40 and the 7 and 96/100 acre tract of land that was conveyed to John E. Griffith and Norma V. Griffith, his wife, by Deed recorded in said County Clerk’s office in Deed Book 656, at page 321) 689 and 95/100 feet to an iron pin at the northwesterly corner of Lot 21 as shown on the Map of Homestead Farms, said map being recorded in said County Clerk’s office in Plat Book 2, at page 79; thence with the westerly line of same, S. 32 Degrees 06′ W. 864 and 41/100 feet to a point in the centerline of Warden’s Run Road; thence with same the following five (5) bearings and distances: N. 58 Degrees 13′ 51″ W. 677 and 27/100 feet to a point; thence N. 56 Degrees 56′ 07″ W. 106 and 48/100 feet to a point; thence N. 54 Degrees 25′ 53″ W. 72 and 03/100 feet to a point; thence N. 50* 02′ 50″ W. 91 and 88/100 feet to a point, thence N. 47 Degrees 50′ 29″ W. 95 and 11/100 feet to a point at the most southerly corner of the aforesaid 2 and 3,698/10,000 acre tract; thence with same the following five (5) bearings and distances: N. 31* 12′ 30″ E. 128 and 05/100 feet to a point; thence N. 15 Degrees 54′ 50″ E. 271 and 35/100 feet to a point, thence N. 79 Degrees 47′ 20″ W. 210 and 95/100 feet to a point; thence N. 87 Degrees 12′ 05″ W. 143 and 76/100 feet to a point; thence S. 42 Degrees 14′ 40″ W. 133 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, on June 25, 2003, twenty-four and five hundred forty-seven one thousandths (24 and 547/1000) acres, more or less. There is also granted to the party of the second part hereto, the right to use the present drive leading from Warden’s Run Road through the southeasterly corner of the 1 and 422/1000 acre tract remaining to the party of the first part hereto, to the southwesterly corner of said 24 and 547/1000 acre tract. Said 24 and 547/1000 acre tract being subject to the right of the owners of the 5 and 66/100 acre tract (now or formerly owned by Schenerlein), to use said drive as it passes through the southwesterly corner of said 24 and 547/1000 acre tract, said drive to be used in common by both parties hereto, their heirs and assigns. Said tract being subject to that part of the right-of-way for the said Warden’s Run Road that is included within its boundaries. There is excepted and reserved from the above described real estate that certain 5.255 acre parcel which was heretofore conveyed by Sean O’Brien to Frank O’Brien and Whitney O’Brien, a married couple, by a Deed dated the 17th day of June, 2019, and recorded in the aforesaid County Clerk’s office in Deed Book No. 962, at page 216.

TERMS OF SALE

1. Cash in hand paid on the day of sale.
2. The sale of the property will be made subject to all matters having priority over the deed of trust referred to herein including but not limited to any and all assessments and taxes against said property, all prior liens, encumbrances, lease, restrictions, covenants, conditions, rights of way and easements of any nature whatsoever.
3. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code Section 11-22-2.
4. The subject property will be sold in “AS IS” condition. The Substitute Trustee makes no representations and warranties of any kind or character including, but not limited to, the condition of the real estate or the title to the real estate to be conveyed.
5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
6. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of the sale described above.
7. The beneficiary of the Deed of Trust and holder of the note thereby secured reserves the right to submit a bid for the property at the sale, which bid may be in the form of a credit bid.
8. Such other terms as may be announced at the time of Sale.
