NOTICE OF TRUSTEE’S SALE OF VALUABLE REAL ESTATE

Notice is hereby given that the undersigned Trustee, will sell at public auction to the highest bidder on:

May 13, 2025, at
10:00 a.m.,

at 1659 Boggs Run Road, Benwood, West Virginia, that certain property conveyed by Paulette Schott to James C. Gardill, Trustee, by Deed of Trust dated May 22, 2018, and recorded in the office of the said Clerk of the County Commission of Marshall County, West Virginia, in Deed of Trust Book 1019, at page 566, and being described as follows:
The following described lot or parcel of land situate on Boggs Run, in Union District, Marshall County, West Virginia, bounded and described as follows, that is to say:
A certain lot or parcel of land situate on the south side of Boggs Run, which is designated by a plat of survey made by Wilbert Jones, surveyor of Marshall County, West Virginia, which is designated on said plat as Lot Number Three (3) described as follows, to-wit, beginning at a stake on the south side of Boggs Run county road, thence South 66* 30′ East fifty (50) feet to a stake; thence South 23* 30′ West one hundred fourteen feet and eleven hundredths (114.11) to a stake or low water mark; thence South 89* 45′ West fifty-four and sixty-four hundredths (54.64) feet to a stake; thence North 23* 30′ East one hundred thirty-six and one-tenth (136.1) feet to a stake on the south side of said county road and place of beginning, containing 6256 square feet, more or less. There is also granted to the parties of the second part hereto all of the first parties’ right, title and interest in and to any land lying between the rear or southerly line of the herein described parcel and Boggs Run. Excepting and reserving, however, and not hereby conveyed, is the following parcel of land situate on the southerly side of Boggs Run Road, Union District, Marshall County, West Virginia, and comprising the easterly part of Lot No. 3, as shown on the plat of Henry Myers, a copy of said plat being recorded in said Clerk’s office in Deed Book 99, at page 317 and being more particularly bounded and described as follows:
Beginning at a point in the southerly line of Boggs Run Road, as established by said plat, at its intersection with the division line between Lots No. 2 and 3, as shown on said plat; thence from said beginning point and with said division line between Lots No. 2 and 3, S. 23 degrees 30′ W. 114 and 11/100 feet to a point in the rear or southerly line of said Lot No. 3; thence following along said rear or southerly line, S. 89 degrees 45′ W. 2 and 8/100 feet to a point; thence with other property now owned by the parties of the first part, hereto, N. 23 degrees 24′ E. (at 5 and 89/100 feet passing through an iron pin and then passing a point 6 feet distant measured in a northwesterly direction from the most westerly corner of the dwelling now standing on Lot No. 2 and then passing another point 6 feet distant, measured in a northwesterly direction from the most northerly corner of said dwelling) 114 and 95/100 feet to a point in said southerly line of Boggs Run Road; thence with same, S. 66* 30′ E. 2 and 1/10 feet to the place of beginning, as the same was surveyed by Stegman & Schellhase, Inc., Civil Engineers and Surveyors. Being the same property conveyed to Frederick W. Schott and Paulette F. Schott, his wife, from Larry L. Wright and Gabriele Wright, his wife, by Survivorship Deed dated June 29, 1976, and of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Deed Book 459, Page 317. The said Frederick W. Schott died on March 27, 2003, and by the survivorship provision of said deed, title vested in Paulette F. Schott, his wife.

The terms of the sale will be as follows: Cash in hand on the day of sale. Sale of said property will be made subject to: (1) All prior exceptions, reservations, rights of ways easements, conditions, covenants, restrictions, leases and other servitude’s of record if any pertaining to said real estate: (2) any and all unpaid taxes assessed against said property: (3) The subject property will be sold in “as is” condition: (4) The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property: (5) The Trustee will deliver a Trustee’s Deed to the purchaser without any covenant or warranty (expressed or implied) in the form prescribed by West Virginia Code Chapter 38-1-6. The Trustee makes no representations and warranties about the title of the real estate to be conveyed. Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Trustee reserves the right to reject any or all bids. Additional terms and conditions shall be announced at the sale.
Any sale hereunder in which the property is encumbered by Federal Tax Liens will be subject to the 120 day redemption period pursuant to 26 U.S.C.A. Sction 7424(d).
