TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 19, 2007, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed of Trust Book 1322, at Page 712, Eric W. Keller did convey unto John R. Lukens, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse, in Wheeling, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
That parcel of real property situate in the City of Wheeling Ohio County, West Virginia known as Howard Place, which is designated as Lot No. 6 on the map of said Howard Place made by C.C. Smith, Engineer, said property being more particularly described as follows, that is to say:
Beginning at a cross cut in a stone wall on the easterly side of the National Road, said cross being at a common corner to Lots No. 5 and No. 6 as the said Lots are shown on the plat of Howard Place (said map prepared by C.C. Smith’s Sons, Engineers, Wheeling, West Virginia, and revised June 22, 1946), and being of record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 338, at Page 115, thence with the division line between said Lots No. 5 and No. 6 N. 66 deg 01′ 30″ E. 225.00 feet to a point on the westerly side of Fairfax Drive; thence S. 23 deg 58′ 30″ E. 80.00 feet to a point on the said westerly side of Fairfax Drive; thence with the division line between Lots No. 6 and No. 7 and its northeasterly extension S. 66 deg 01′ 30″ W. (at 224.00 feet passing thru a cross cut in the top of the said stone wall)225.00 feet to a point, thence N. 23 deg 58′ 30″ W. 80.00 feet to the place of beginning. The parties of the first part do also hereby grant to the party of the second part the right of way for a road Ten (10) feet wide extending from the East end of said Lot No. 6 eastward across the park land, being the same right of way that was conveyed to Freda M. Kessor by Agnes Jane Howard and John A. Ward, her husband, which deed is dated the 28th day of April, 1921, and which Deed is of record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book 176, at Page 341. This grant is for the purpose of ingress and egress from the said road to the rear of said Lot No. 6.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1447 National Road, Wheeling, WV 26003.
AND BEING the same real estate which was conveyed to Eric W. Keller, by Deed dated April 19, 2007, from William D. Dague and Ann M. Reece-Daugue, and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Deed Book 776, at Page 136.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
