NOTICE OF
TRUSTEE’S SALE
Notice is hereby given by the undersigned, David F. Cross, Substitute Trustee by Notice of Substitution of Trustee, dated June 17, 2019, which notice is of record in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Trust Deed Book 1584, at Page 564, and by Deed of Trust dated February 13, 2017, executed by Wilfred L. Spencer, III, to John E. Gompers, to secure Main Street Bank, recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Trust Deed Book 1540, at Page No. 696, the Substitute Trustee has been requested in writing by the beneficiary of said Deed of Trust to sell the real estate described below, as there has been a default under the terms and conditions of said Deed of Trust. Therefore, the undersigned Substitute Trustee will sell the real estate described in the Deed of Trust at public auction to the highest bidder on November 7, 2019, at 9:00 a.m., at the front door of the Courthouse of Ohio County, in Wheeling, West Virginia. The subject real estate is more particularly described as follows:

All of that certain lot or parcel of ground situate in Richland District, Ohio County, West Virginia, and shown and defined as Lot Numbered Thirteen (13) West of Wheeling Avenue on the Plat of Loveland, which Plat is recorded in the office of the Clerk of the County Court of Ohio County, West Virginia, in Plat Book No. 1, at page 113.

Together with all and singular, the buildings and improvements situate thereon and the appurtenances and hereditaments thereunto belonging.

This conveyance is subject, however, to the building line restrictions and the building restrictions set out in deed from George L. Hill and wife to Raymond J. Libeer and wife, and recorded in Deed Book 179 at page 385.

The subject property has an address of 513 Warwood Avenue, Wheeling, West Virginia, 26003.

TERMS OF SALE

1. Cash in hand paid on the day of sale.
2. Subject to any and all assessments and taxes against said property, and all prior liens and encumbrances of any nature whatsoever.
3. The purchaser shall be responsible for payment of the transfer taxes imposed by Article 2 of Chapter 11 of the West Virginia Code.
4. The Substitute Trustee reserves the right to adjourn the sale, for a time, or from time to time, without further notice by announcement at the time and place of sale described or any adjournment thereof.
5. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. The Substitute Trustee will deliver a trustee’s deed to the purchaser without any covenant or warranty (express or implied) in the form prescribed by W. Va. Code Section 38-1-6. The Substitute Trustee makes no representations and warranties about the title of the real estate to be conveyed.
