COMMISSIONER’S SALE OF VALUABLE REAL ESTATE
August 21, 2019
at 11:00 a.m.

Notice of Commissioner’s Sale is hereby given pursuant to and by virtue of the authority vested in the Special Commissioner, Shane Mallett, pursuant to Order of the Circuit Court of Marshall County, West Virginia in a Civil Action designated as Wakim v. Tucker et. al., Marshall County Civil Action No. 17-C-143, wherein the Circuit Court directed the Commissioner to make sale of the herein described real estate. Accordingly, the undersigned Commissioner will sell the following described tracts of real estate, at public auction and to the highest bidder, on:

WEDNESDAY, AUGUST 21, 2019 at 11:00 a.m.

The real estate will be sold on the Courthouse steps of the Marshall County Courthouse, 600 7th Street, Moundsville, WV 26041.

The real estate being sold is more particularly described as follows:

CHEROKEE HILLS
PROPERTY:
All that certain tract or parcel of real estate, together with all improvements, rights, ways, waters, and appurtenances, designated as Lot Number Twenty (30) on that certain Plat of Simmons’ Second Cherokee Hills Addition to Moundsville, West Virginia, which Plat is of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia, in Plat Book No. 1 at Page 71.

SECOND STREET
PROPERTY:
All that certain tract or parcel of real estate containing 3,053 square feet, more or less, together with all improvements, rights, ways, waters, and appurtenances thereunto belonging, and more particularly described as follows:

Beginning at a cross cut in concrete in the southerly line of Second Street, at the northeast corner of a parcel conveyed to Rex O. Wood and Norma M. Wood in Deed Book 372, page 326, thence with the easterly line of said parcel in a southerly direction 120.0 feet to an iron pin in the northerly line of an alley, thence with said alley in a westerly direction 25.07 feet to an iron pin, thence in a northerly direction 120.0 feet to an iron pin in the southerly line of Second Street, thence with said line in an easterly direction 25.82 feet to the place of beginning, containing 3053 square feet, more or less, according to a survey by Chadan Engineering, Inc., in September, 2010. This plat of said survey is attached hereto and made a part of this deed.

LOT 20:
All that certain tract or parcel of real estate, together with all improvements, rights, ways, waters, and appurtenances thereunto belonging, and designated as Lot Twenty (20) in Section Four (4) of the Moundsville Mining and Manufacturing Company’s Addition, a plat of which said Addition is of record in the Office of the Clerk of the County Commission of Marshall County, West Virginia in Deed Book 39, page 618, to which plat reference is here made for a more particular description.

The real estate will be conveyed in “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-way, easements, covenants, conveyances, and conditions of record in the aforesaid Clerk’s Office or affecting the aforesaid real estate.

The Beneficiary of any Deeds of Trust and Notes, and the Plaintiff Creditor in the aforesaid Civil Action, reserve the right to submit a bid for the real estate being offered for sale at the sale.

The Commissioner further reserves the right to continue the sale from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Commissioner.

Each tract of land may be sold individually, collectively, and in any order. The Commissioner will declare the real estate sold to the bidder offering the highest bid for the real estate being sold, whether as a unit or individually.

The Commissioner shall be under no duty or obligation to cause any existing tenant or person occupying the real estate to vacate the aforesaid real estate, and any personal property or belongings remaining on the real estate after the sale will be deemed to constitute abandoned property and will be disposed of.

Terms of the sale are ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) down to be paid on the day of the sale, and the balance to be paid within 30 days of the date of the sale. The successful bidder shall be responsible for all costs associated with the transfer of the real estate.
