PUBLIC NOTICE OF PROPOSED ORDINANCE
RELATING TO WATER RATES, FEES,
AND CHARGES
MARSHALL COUNTY PUBLIC SERVICE DISTRICT NO. 1, WHEELING, WV
Notice is hereby given, that, on the 12th day of June, 2025, the Marshall County Public Service District No. 1, Wheeling, West Virginia caused to be read an Ordinance proposing increased rates, fees and charges in lieu of those rates and charges contained in its Tariff P.S.C. W.Va. Form No. 12, currently on file with the Public Service Commission of West Virginia, for furnishing water service to approximately 1500 customers in the Marshall County Public Service District No. 1, Wheeling, West Virginia and is proposing the adoption of the same. The principal object of the proposed ordinance is to increase the water rates to provide necessary future revenue to provide funds for monthly expenses associated with overall operation, billing, meter reading, and related office/administrative and contingent expenses, as well as to service long term debt.
The Marshall County Public Service District No. 1, Wheeling, West Virginia will have its final reading and final vote on the adoption of the ordinance on JULY 10, 2025, AT 4:30 P.M.. The meeting for the vote on said adoption will be open to the public and will be held in the Marshall County Public Service District No. 1, Wheeling, West Virginia building at 3537 Fairmont Pike Road, Wheeling,WV 26003. Interested parties are invited to appear at the meeting and be heard with respect to the proposed rates, fees or charges.
A complete copy of the proposed ordinance is available for public inspection on the public bulletin board at the Marshall County Public Service District No. 1, Wheeling, West Virginia building as well as the office of the Marshall County Public Service District No. 1, Wheeling, West Virginia. The title of the ordinance is as follows:
AN ORDNANCE INCREASING WATER RATES AND CERTAIN RELATED CHARGES FOR THE MARSHALL COUNTY PUBLIC SERVICE DISTRICT NO. 1, WHEELING, WEST VIRGINIA, TO AMEND THE EXISTING WATER RATES AND TARIFF
The rates and charges being proposed are:
WATER RATES AND CHARGES
For the operation of the water system of the Marshall County Public Service District No. 1, Wheeling, West Virginia and the payment of proper and reasonable expenses of operations, maintenance, repairs, replacements, improvements, additions, betterments of the water system and for the payment of all sums required to pay the principal and interest of all revenue bonds and to meet all applicable reserve requirements as the same become due, there is hereby established a schedule of just and equitable rates and charges for the use of the water system of the Marshall CountyPublic Service District No. 1, Wheeling,West Virginia, which schedule of rates and charges, based upon the metered amount of water supplied to the premises served, except as otherwise specified herein, shall be:
(a) The schedule of rates and charges to take effect September 1, 2025, for water services shall be as follows:
(1) Water – Metered Rate.
First 3,000 gallons used per month; $ 12.70 per 1,000 gallons
next 2,000 gallons used per month; $ 11.57 per 1,000 gallons
next 5,000 gallons used per month; $ 11.57 per 1,000 gallons
next 20,000 gallons used per month; $ 10.75 per 1,000 gallons
next 70,000 gallons used per month; $ 8.70 per 1,000 gallons
all over 100,000 gallons used per month; $ 7.42 per 1,000 gallons
(2) Sales for Resale. All water for resale to Ohio County Public Service District, and any future resellers will be billed at the rate of $6.58 per 1,000 gallons.
(3) Water – Non-Metered / Flat Rate. None.
(4) Minimum Charge. No water bill will be rendered for less than the following amounts according to the size of each meter installed (for customers with multiple meters, the minimum charge will be the sum of the minimum charges for each of the individual meters), to wit:

(5) Customer Security Deposit. Not to exceed two times the average monthly bill for the applicant’s specific customer class or FiftyDollars, whichever is greater. This fee may be changed by applicable statutory provisions. (PSC Rule 8-19-12a)
(6) Tap Fee. The following charges are to be made whenever the utility installs a new tap to serve
an applicant.
A tap fee of $100.00 will be charged to customers applying for service before construction is completed adjacent to the customer’s premises in connection with a certificate proceeding before the Commission. This pre-construction tap fee will be invalid after the completion of construction adjacent to an applicant’s premises that is associated with a certificate proceeding.
A tap fee of $250.00 will be charged to all customers who apply for service outside of a certificate proceeding before the Commission for each new tap to the system.
(7) Delayed Payment Penalty; Termination of Water Service for Non-Payment of Bill and Reconnection Charges. Charges for water services, are billed on a single monthly bill. If the entire amount of the monthly bill for water is not timely paid in full, a delayed payment penalty as set forth below will be applied. If a bill remains unpaid for more than thirty days after the billing date, water service to the delinquent customer is subject to termination and to the imposition of termination and
reconnection charges as set forth below:
A. On all bills not paid in full within the latest pay date, ten percent (10%) will be added to net amount shown thereon.
B. If any bill is not paid in full within thirty (30) days of the billing date, water service to the premises served will be subject to a termination notice advising of disconnection to occur 10 days after issuance of the delinquent notice. Water services will not be restored thereafter until all past due bills have been paid in full and all accrued penalties have been paid plus a reconnection charge of twenty-five dollars ($25); provided, that no more than one reconnection charge shall be imposed for each termination of service for non-payment of a bill.
(8) Leak Adjustment. $4.71 per 1,000 gallons is to be used when the bill reflects unusual consumption which can be attributed to eligible leakage on the customer’s side of the meter. This rate shall be applied to all such unusual consumption above 200% of the customer’s historical average usage.
(9) Recovery of Bank Charges. If a bank or other financial institution returns a customer’s check to the service district due to insufficient funds in such customer’s account and charges a fee to the service district for such service, then the fee charged will be added to the account of the customer whose check is returned. An additional bad check fee of $35.00 will be charged.
(b) This schedule of rates and charges shall take effect September 1, 2025, and remain effective until subsequently duly modified.
