Pursuant to Rule 4(e)(1)(E) of the West Virginia Rules of Civil Procedure, you are
required to answer the complaint filed by Petitioner-in the above titled matter-who
seeks to quiet title in oil and gas and all other minerals underlying Real Property
located in Wetzel County, West Virginia, (legal description below). Plaintiff is
demanding title be quieted in his name with all other adverse interests being
extinguished. In case of your failure to answer/respond, judgment will be rendered
against you according to Plaintiff’s demand. Since your identities and whereabouts
are unknown and the ordinary process of law cannot be served upon you, a copy of
this LEGAL NOTICE shall be published in the Newspaper once per week for three
successive weeks. You are directed to answer/respond in this matter within thirty (30)
days after final publication LEGAL NOTICE.
Legal Description: One-half of the oil and gas to be produced in and underlying all that certain tract of land situated in Center District, Wetzel County, West Virginia o the waters of Little Fishing Creek and Rocky Run and bounded and described as follows, to-wit:
Beginning at a hickory, a corner by Marcelus Postlethwaite’s line S. 57% E. 16 poles
to a stake in the road, thence with the road S. 39 % E. 14 poles to a stake in the road
thence with the road S. 46 E. 37 % to a stake near the barn, thence N. 75 E. 18 poles
to a stake in the road, thence S. 45 % E. 13 poles to a stone in the road corner to J. A.
Postlethwaite and Martha Cumberledges thence with their line N. 59 E. 41 poles to a
sugar corner in Peter Whites line thence n. 57% W. 63% poles to a poplar in Peter
Whites line and corner to Johnathon Morris Heirs, thence with Mooris Heir’s line N
42 %. W. 67 poles to an oak corner to Ruth Morris heirs and Marcelus Postlethwaite
at the road, thence with the road S. 16 W.18 poles to a stone in the road thence with
the stake in the road thence S. 31 W. 23 poles and 4 links to a hickory the beginning
corner containing forty- one and one-fourth acre more or less.
