authority vested in him by that certain Deed of Trust,
dated December 17, 2018, and duly recorded in the
Office of the Clerk of the County Commission of Wetzel
County, West Virginia, in Document No. 261216, in
Book No. 420, at Page 541, and modified by Corrective
Affidavit recorded in Document No. 386732, in Book
No. 161, at Page 263, Brandon Harris and Stephanie
Harris did convey unto Douglas McElwee, Trustee(s),
certain real property described in said Deed of Trust;
and the beneficiary has elected to appoint Seneca
Trustees, Inc., as Substitute Trustee; and default having
been made under the aforementioned Deed of Trust,
and the undersigned Substitute Trustee having been i
structed by Rocket Mortgage, LLC f/k/a Quicken Loans,
LLC f/k/a Quicken Loans Inc. to foreclose thereunder,
will offer for sale at public auction at the front door of the
Wetzel County Courthouse in New Martinsville, West
Virginia, on

A tract or parcel of land lying and being situate on the
waters of the Ohio River, in Magnolia District, Wetzel
County, West Virginia, more particularly described as

BEGINNING at a point at the intersection of the center
of Route 30 and the eastern line of the Old Clarksburg
Northern Railroad Right of Way at the corner of Lot 1 of
the Jack Glendenning Estate of reference in Will Book
69 page 839 and shown on a plat of the said
Glendenning Estate as the P.O.B. Lot 1, the said point
is also in the line of the Winland tract of record in Deed
Book 317 page 71;
thence with the said Route 30 for the following ten
courses and distances which will be with the said
Winland tract and then the Hoskins tract of record in

110.70′ to a point in the said Route 30;

record in Deed Book 329 page 689, at the common
corner of Lots 2 & 3 of the Jack Glendenning Estate of
reference in Will Book 69 page 839, shown on a plat of
the said Glendenning Estate as the P.O.B. Lot 2 & 3, at
or near the center of the Old Hill Road reference a plat
of record in Deed Book 194 page 231, the said point is
about 13′ from the center of the existing traveled way of
Route 30, and at the southeastern corner of a 20′ x 43′
new right of way, (witness an iron pipe found in the
center of the said Old Hill Road at the base of the
sycamore tree at the corner of the said Miller tract and
at the corner of the Emch tract of record in Deed Book
431 page 162, the said Emch tract calls for a stake
and syc. Pts in the old road which bears S 22 44′ 50″ W
a distance of 27.61′)

corner of Lots 2 & 3 of the Jack Glendenning Estate of

continuing 11.7′) for a total distance of 173.43′ the point
of beginning, having an area of 0.989 acre as surveyed
by Moody Land Surveying, LLC on the 5th day of March
2013, and more particularly designated as Lot 3 and
shown on a plat attached to Book 435, Page 556 and
incorporated herein by reference.
Further granting and conveying unto the Grantee, a 20′
wide by 43′ long RIGHT OF WAY bordering Lot 2 for 43′
& the Miller tract for 20′ as shown on the aforesaid plat.
Commonly known as: 414 Whiteman Hill Rd, New
Martinsville, WV 26155-8210.
At the time of the execution of the Deed of Trust, this
property was reported to have an address of: 414
Whiteman Hill Rd, New Martinsville, WV 26155.
The referenced real estate will be conveyed with no
covenants of warranty, and subject to all covenants,
restrictions, easements, rights of way and reservations
which may be a matter of record in the aforesaid Clerk’s
Office or visible upon the ground, all prior liens and
encumbrances, including, without limitation, liens for
real estate taxes, incinerator, sanitary and sewer
charges. The purchasers at the sale shall be
responsible for paying the recording costs and also the
tax on the privilege of transferring real property (the cost
of the tax stamp to be affixed to the deed).
The purchasers shall be responsible for payment of all
real estate taxes.
The subject property will be sold in “AS IS” condition.
The Substitute Trustee shall be under no duty to cause
any existing tenant or person occupying the subject
property to vacate said property.
TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are
Federal Tax Liens against the property, the United
States would have the right to redeem the property
within a period of 120 days from the date of such sale or
the period allowable for redemption under local
law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may
postpone the sale by public announcement at the time
and place designated or by posting a notice of the
same, and act by agent in the execution of the sale. The
parties secured by the Deed of Trust reserve the
right to purchase the property at such sale.
