NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 7, 2013, executed by Borrower(s), Veronica Larsson, to Douglas McElwee, the Trustee of record in the office of the Clerk of the County Commission of Lewis County, West Virginia, in Book 403, at Page 52. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 294 Landmark Ests, Jane Lew, WV 26378. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated June 16, 2025, of record in the Clerk’s Office in Book 478, Page 593. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Lewis County, in Weston, West Virginia, on the following date: 8th day of August, 2025 at 11:30 a.m. All of that certain tract or parcel of land lying and being situate on the waters of Broad Run in Hacker`s Creek District, Lewis County, West Virginia, and being more particularly bounded and described as follows: BEGINNING at a 3/4″ rebar set, corner to Lot 13, thence; N. 43-00-00 E. 118.95` to a 3/4″ rebar, set, corner to Lot 9, thence with Lot 9; S. 55-52-20 E. 276-69` to a 3/4` rebar, set, corner to Lot 9, thence with Lot 9 for part of a line; S. 33-00-10 E. at 107.93 passing a 3/4″ rebar, set, corner to Lot 9 and 10, in all 140.43` to a 3/4″ rebar, set, corner to Lot 10, thence with Lot 10; S. 07-04-20 E. 225.91` to a 3/4″ rebar, set on the northern limits of a 40 foot right of way, thence with said right of way; S. 86-15-20 W. 66.76` to a 3/4″ rebar, set, thence leaving said right of way; N. 40-00-00 W. 541.17` to the place of beginning, as surveyed in June, 1995, by Landmark Surveying and Forestry of Weston, M. Allen Arden PS No. 959, and Designated as Lot No. 11 shown on a plat of survey for Landmark Estates. For the consideration aforesaid, the parties of the first part do further grant and convey unto the parties of the second part, their successors, transferees and assigns, a right of way, over and across an existing stone base road, being 30.0 feet in width front County Route No. 8 to the corner of Lot 7 and Lot 1 of Landmark Estates Subdivision, at which point the width is increased to a 40.0 foot wide right of way as shown and depicted on the Subdivision Plat of Landmark Estates to be recorded in the aforesaid Clerk`s Office. Said right of way to be used for the purposes of ingress, egress and regress, and further, for the purposes of laying, maintaining, repairing and replacing one or more pipelines, for the transportation of water, natural gas and/or sewage and electrical distribution and telephone lines, television cable, or any other utility, whether of the same or different service, to the real estate herein conveyed. Said right of way is to be used in common with parties of the first part, their successors, transferees and assigns, and other having heretofore been granted the privilege of using said right of way, and will be maintained by the lot owners of said Subdivision. However, the parties of the first part expressly reserve the right to dedicate said right of way to the West Virginia Department of Highways as a public roadway. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
