TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated May 12, 2006, and duly recorded in the Office of the Clerk of the County Commission of Taylor County, West Virginia, in Document No. 200600000973, in Book No. 245, at Page 303, Margaret J Prickett and William G Prickett did convey unto Janet Phillips, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Metropolitan Life Insurance Company to foreclose thereunder, will offer for sale at public auction at the front door of the Taylor County Courthouse Annex in Grafton, West Virginia, on August 27, 2025 at 1:30 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 03 – Booths Creek District, Taylor County, West Virginia, and more particularly described as follows: The following parcel of real estate situate in Booths Creek District, Taylor County, West Virginia, bounded and described as follows: Beginning at a point 59.19 feet northwest of W. E. 905.82 feet to a post in the western line of the right of way of U. S. Highway No. 250, thence with said right of way line S. 67 deg. 21 min. E. 503.66 feet to a stake; thence S. 64 deg. 46 min. E. 141.2 feet to a stake, and thence S. 58 deg. 7 min. E. 121.37 feet to a stake at the junction point of said U. S. Highway No. 250 and said W. Va. At the time of the execution of the Deed of Trust, this property was reported to have an address of: RR4 Box185A, Grafton, WV 26354. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FIVE THOUSAND SIX HUNDRED AND FORTY DOLLARS ($5,640.00) IN UNITED STATES CURRENCY, ET AL., RESPONDENT. CIVIL ACTION NO. CC-49-2025-p-37 NOTICE OF FILING OF PETITION FOR FORFEITURE The object of this suit is to seek an Order forfeiting the herein described property pursuant to the West Virginia Contraband Forfeiture Act (Chapter 60A, Article 7, of the West Virginia Code, as amended). To any Claimant: The confiscated money is subject to administrative forfeiture unless you provide a written notice, within thirty (30) days of receipt of this notice, that you wish to contest this forfeiture. If you fail to provide a written notice to the prosecuting attorney, you will immediately and forever lose all right, claim, title and interest to the confiscated money, and it will be disposed of according to law. Any such claim must clearly state the identity of the Claimant and an address where legal process can be served upon said Claimant. The property seized and subject of this suit was in the custody, possession, or control of Justin Christopher Stevens on May 27, 2025, at approximately 12:01 p.m., at or near 34 Serviceberry Lane, Buckhannon, Upshur County, West Virginia, and is described as follows: Five Thousand Six Hundred and Forty Dollars ($5,640.00) in United States currency. The law enforcement agency responsible for this seizure is with the Upshur County Sheriff’s Department. That after the date for filing of said claims, an Order of the Court directing forfeiture of the seized property to the State and vesting ownership of said property shall be sought. If you fail to file a claim, thereafter an Order, upon proper hearing, may be entered against you for the relief demanded in the Petition.
