IN THE MATTER OF OHIO COUNTY CASE # 19-CJA-4 and 7, KELLY BRACKEN, biological mother of infant D.R.B., whose date of birth is November 20, 2008 and occasional custodian of infant L.B. whose date of birth is May 17, 2002, and FRANCIS BRACKEN, biological father of infant D.R.B. whose date of birth is November 20, 2008 and L.B., whose date of birth is May 17, 2002. D.R.B. being the natural child of KELLY BRACKEN.
The Petitioner, the West Virginia Department of Health and Human Resources has filed a Petition that may result in the termination of parental rights of KELLY BRACKEN, biological mother and custodian of infant D.R.B., whose date of birth is November 20, 2008 and occasional custodian of infant L.B. whose date of birth is May 17, 2002, and FRANCIS BRACKEN, biological father of infant D.R.B. whose date of birth is November 20, 2008 and L.B., whose date of birth is May 17, 2002.
The Petitioner has filed a Petition alleging that KELLY BRACKEN AND FRANCIS BRACKEN have abused and neglected, abandoned, or failed to provide for the care, custody and control of infants D.R.B. whose date of birth is November 20, 2008 and L.B., whose date of birth is May 17, 2002. It is ORDERED that KELLY BRACKEN AND FRANCIS BRACKEN are notified that they may obtain a copy of the Petition from the Clerk of the Circuit Court of Ohio County, West Virginia and they are further ORDERED to appear in the courtroom of the Honorable David J. Sims, Judge of the Circuit Court of Ohio County, West Virginia, Fifth Floor, Ohio County Courthouse, Wheeling, West Virginia on the 18th day of September, 2019 at 9:00 a.m. for a Motion Hearing and Disposition Hearing if they so desire to object or make other defense to the Petition; otherwise, parental rights of KELLY BRACKEN, biological mother and custodian of infant D.R.B., whose date of birth is November 20, 2008 and occasional custodian of infant L.B. whose date of birth is May 17, 2002, and FRANCIS BRACKEN, biological father of infant D.R.B. whose date of birth is November 20, 2008 and L.B., whose date of birth is May 17, 2002, may be terminated.
