NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated February 10, 2022, executed by the Borrower, Michael L. Carnahan, to Old Republic National Title Insurance Company, the Trustee, of record in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Book 643, at Page 243. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1116 Shady Grove Rd., Bruceton Mills, WV 26525. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated June 2, 2025, of record in the Clerk’s Office in Book 680, at Page 637. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Preston County, in Kingwood, West Virginia, on the following date: August 19, 2025, at 9:30 a.m. All that certain piece or parcel of land situate in Grant District, Preston County, West Virginia, more particularly bounded and described as follows: BEGINNING at a 5/8″ bar, found, on the south side, edge of a 30` r/w for County and Secondary Rt. 5/7, and a corner to Mary Hartley (DB 521, pg 385); thence with Hartley S 29 39` 25″ W 425.00 feet, to a 5/8″ bar, set, on a line of Hartley and a new corner to Robert Pike (DB 737, pg 751); thence through Pike, N 71 30` 29″ W 406.71 feet to a 5/8″ bar, set, on a line of Robert Pike (DB 736, pg 484); thence with Pike N 30 06` 24″ E 425.00 feet to a point, located on the south side of a 30` road (public) right of way of WV Secondary Rt. 5/7; thence with the south side r/w of WV Secondary Rt. 5/7, S 71 34` 49″ E 404.17 feet to the point of beginning, and containing 3.878 acres, as shown on a plat of survey dated August 18, 2020, by Randall R. Myers, PLS #751, of record in the office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book 846, at Page 47. And being the same real estate conveyed to the Grantor herein by Robert Allen Pike, Sr, and others, by Deed dated January 24, 2022, and recorded in the office of the Clerk of the County Commission of Preston County, West Virginia, in Deed Book 846, at page 43, to which deed and plat attached thereto reference is hereby made. And for the consideration aforesaid, the Grantors herein do further grant and convey unto the Grantee, the joint, appurtenant right to the use of that certain road right-of-way shown on the plats of survey attached hereto as “access to this lot is by this road” and “30′ R/W across Lot to remainder”, for ingress, egress and regress to and from the real estate herein conveyed and West Virginia Secondary Route 5/7, said right-of-way being for the joint use and benefit of Grantors, herein, their heirs, successors and assigns, and the Grantee herein, his heirs, successors and assigns, as shown on said plat of survey in Deed Book 710, at page 50, to and partially shown on that plat of survey in Deed Book 627, at page 266, to all of which reference is hereby made. There is reserved the joint use of said right-of-way shown on said plat of survey as “30` R/W across lot to remainder” and “access to this lot is by this road” for ingress, egress and regress to and from the remaining property of Mary L. Hartley and across the real estate herein conveyed, and continuing then to West Virginia Secondary 5/7. Said right-of-way being for the joint use and benefit of Mary L. Hartley, her heirs, successors and assigns, and the Grantee herein, their heirs, successors and assigns, as shown on said plat of survey in Deed Book 710, at page 50, to which reference is hereby made. This conveyance is made together with all buildings and improvements, rights, road, ways, easements, privileges, appurtenances, and advantages thereto belonging or in any way appertaining. This conveyance is further made subject to any and all reservations, restrictions, conditions, covenants, easements, rights of way, prior out conveyances, prior conveyances of minerals and. rights to extract the same or conditions which may appear in prior deeds in the chain of title to said parcel of real estate. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
