NOTICE OF TRUSTEE’S SALE By virtue of the execution of a certain deed of trust dated April 8, 2024, recorded in the Office of the Clerk of the County Commission of Preston County, West Virginia, in Trust Deed Book 668, page 118, made and executed by Ottis Dwight Davis to Timothy R. Aiken, trustee, to secure Union Bank, Inc., a corporation, in the payment of the deed of trust obligation therein fully set forth, and Logan Hassig, whose principal residence is 505 Greenbriar Court, New Martinsville, Wetzel County, West Virginia, having been appointed as Successor Trustee by “Appointment of Successor Trustee Agreement” recorded in the aforesaid Clerk’s Office in Trust Deed Book 679, page 47, and the said Trustee having been required by the said beneficiary so to do, the undersigned Trustee will sell said property to the highest and best bidder at the front door of the courthouse in Preston County, West Virginia, at Kingwood, West Virginia, on Thursday, September 4, 2025 at 11:00 a.m. Said deed of trust property, with the appurtenances thereunto belonging, situate in Preston County, West Virginia, and is more particularly described as follows, to-wit: An undivided one-half (1/2) interest in and to the following described real estate situate on the waters of Buffalo Creek, Reno District, Preston County, West Virginia and more particularly bound and described as follows: Beginning for the first of said parcels at a large planted stone and stone pile, an old comer, standing on the west bank of Shev-Dofrize Run S. 82 30′ W. 56 poles to the southeast comer of lands of Frank Funk and running thence N. 82 30′ E. 56 poles to a stone pile, the said southeast comer of Frank Funk’s land; thence W. 492 1/2 poles to a stone pile in the west boundary line of the original tract which is also the southwest comer of E. R. Schooly’s land; thence S. 444 poles to a stone pile at the southwest comer of said original tract; thence E. 154 1/2 poles to a maple stump, the southwest comer of a 50 acre tract heretofore conveyed by William T. White, Executor, to Ida M. Knotts by deed dated March 20, 1908 and now of record in the Office of the Clerk of the County Commission of Preston County, West Virginia in Deed Book 122, at page 164, now owned by Wesley Runner; thence N. 117 poles to a stake in stone pile, the northwest comer of said 50 acre tract; thence east 68 1/2 poles to a stone pile at the intersection of post and wire fences, the northeast comer of said 50 acre tract; thence N. 194 poles to a planted stone standing on the north of an old trarnroad grade, east 181 1/2 poles to a stone pile, a comer formerly marked by a maple tree; thence N. 15 15′ E. 124 poles to the place of beginning, containing 730 acres, more or less. There is EXCEPTED and RESERVED that certain 3.66 acres of surface that was conveyed by Ottis D. Davis and Margaret H. Davis, his wife, to Gay Royce by deed dated the 21 st day of March, 1951 and of record in the said Clerk’s Office in Deed Book 294, at page 528. There is also EXCEPTED and RESERVED for the joint lives of Ottis D. Davis and Margaret A. Davis, and the survivor of them,joint life estates in all oil and gas royalties under existing lease, as well as any oil and gas rights under the above described real estate.Being the same property previously conveyed to Grantors from Ottis D. Davis and Margaret H. Davis by deed dated October 3, 1984 and of record in Deed Book 515, at page 714. Ottis D. Davis is one and the same person as Ottis Danny Davis, Jr. named in said prior deed. TERMS OF SALE: 1. The property is being conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of way, easements, covenants, conveyances and conditions of record in the said Clerk’s Office or affecting the subject property. 2. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code 11-22-1. 3. The beneficiary and/or the servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4. The Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5. The Trustee shall be under no duty to cause an existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6. The total purchase price is payable to the Trustee by certified or cashier’s check on the day of sale.
