NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Eric M. Johnson and L. Elizabeth King, by that certain Deed of Trust made by Thomas M. Wilson, II and Aimee J. (Deed Book 315, Page 663) line, from which a 1/2″ pipe set in concrete found bears N. 14 degrees 11′ 00″ E. 286.41′; thence leaving said Mason County Hospital and with said Pleasant Valley Hospital, Inc., S. 14 degrees 11′ 00″ W. 161.60′ to a 2″ iron pipe found, from which an 18″ wild cherry bears S. 36 degrees 39′ E. 5.40′; thence continuing with said Pleasant Valley Hospital S. 72 degrees 32′ 00″ E. 1267.73′ to a “T” post found on the Frank Capehart, III, (Deed Book 186, Page 372) line, from which a 4″ elm bears N. 26 degrees 03′ E. 14.74′ and a 10″ maple bears S. 33 degrees 41′ W. 20.93′; thence leaving said Pleasant Valley Hospital and with said Capehart S. 14 degrees 17′ 09″ W. at 135.02 passing through an iron pin found at a corner of said Capehart and Richard Culver (Deed Book 318, Page 305), 992.67′ (total) to an iron pin set on the said Culver line and said iron pin set also being a corner common to Enabelle See (Deed Book 299, page 184), from which an iron pin found at said Culver corner bears S. 14 Degrees 18′ 09″ W. 174.15′; thence leaving said Culver and with said See line N. 72 degrees 39′ 50″ W. 1528.79′ to the place of beginning, at 1292.34′ passing through an iron pin set, containing 34.350 acres, more or less. Subject to all legal easements, leases and rights of ways of record. All of the oil, gas and other minerals underlying the above described real estate have been excepted and reserved. This conveyance is made subject to all rights of way, easements, restrictive covenants, exceptions, reservations and outconveyances of record which may affect the subject real estate. And being the same real estate conveyed by Marshall R. See and Tara L. See, his wife, to Thomas M. Wilson, II and Aimee J. Wilson, or the survivor thereof, by deed dated the 17th day of March, 2008, and of record in the Office of the Clerk of the County Commission of Mason County, West Virginia, at Deed Book No. 390, page 947. The said parties of the first part further QUITCLAIM, REMISE, and RELEASE unto the parties of the second part, that certain right-of-way, situate in Lewis District, Mason County, West Virginia, which is more particularly described as follows, to-wit: Being a right of way and easement over and across the existing roadway to and from the real estate formerly owned by Jule H. Campbell and Dorothy T. Campbell, situate in Lewis District, Mason County, West Virginia, consisting of 34.350 acres, more or less, which was conveyed by Dorothy T. Campbell, widow, to Ronald E. Jacobs and Deborah L. Jacobs, by deed dated the 4th day of May, 2004, of record in the Office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 373, at Page 609, said right-of-way and easement to be utilized by the parties of the second part, their heirs, assigns and successors in title as a means of ingress and egress to and from the aforesaid real estate formerly owned by said Campbells to that certain public road known as Jericho Road. And being the same right of way and easement conveyed by Dorothy T. Campbell, widow, to Marshall R. See and Tara L. See by Quitclaim Deed dated the 5th day of December, 2007, and of record in the Office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 390, Page 28. At the time of execution of the deed of trust, the grantors represented that the address of the property was 517 Campbell Lane & ETAL, Point Pleasant, WV 25550. TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and The Ohio Valley Bank Company shall not be responsible for the removal of any person or personal property from the Premises. The property will be sold to the highest bidder, who shall be obligated to pay an initial deposit to the Trustees at the time of sale in the minimum amount of 10% of the bid amount, and the remaining balance shall be paid to the Trustees on or within 20 days of the date of the auction. Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale.
