NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated January 19, 2004, executed by Borrower, James A Pillo, to Charles Johnson, the Trustee of record in the office of the Clerk of the County Commission of Harrison County, West Virginia, in Book 1013, at Page 1. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1389 Adamsville Rd f/k/a Route 2 Box 354, Shinnston, WV 26431. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated August 26, 2025, of record in the Clerk’s Office in Book 1537, Page 430. The borrower defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Harrison County, in Clarksburg, West Virginia, on the following date: 12 day of November 2025 at 3:19 p.m. Situated in the State of WV, County of Harrison and in the District of Clay, a description of a certain tract of land of further identified as Parcel “A-1” subdivided from original Parcel “A”, situate on the waters of Coon`s Run and along West Virginia Route No. 12/2, Clay District, Harrison County, West Virginia and more particularly described as follows: Beginning at a set 5/8″ rebar and cap stamped “Wheeler 530″ located on the western right of way line of West Virginia Route No. 12/2, said beginning point being referenced, S. 7 deg. 24` 00″ W. 50.00” from a found power pole described as the original north-eastern corner of Parcel “B” said beginning point also begin further identified as the common south-eastern corner of Parcel “B”, the original north-eastern corner of Parcel “A” and the north-eastern corner of subdivided Parcel “A-1″; thence running with the adjoining western right of way line of West Virginia Route No. 12/2, S. 7 deg. 24` 00″ W. 158.71` to a set 5/8” rebar and cap stamped “Wheeler 530, thence leaving the right of way line of West Virginia Route No. 12/2 and running with the adjoining northern line of a 25.21 acre parcel; S. 69 deg. 30` 00” W. 69.10` to a set tract spike located in a culvert at the center of Coon`s Run, thence running with three new division lines through original Parcel “A”, with the first two lines running with the center of Coon`s Run; N. 19 deg. 00` 29″ W. 47.79` to a point, thence; N. 5 deg. 03` 45″ E. 127.74` to a point, thence leaving the center of the run and continuing with the third new division line; N. 84 deg. 09` 07″ E. 89.93` to the place of beginning containing a total of 13,823 square feet or 0.32 acres more or less as subdivision by survey by D.L. Wheeler & Association, Inc. Professional Surveyors during the month of May 2002. This description of Survey was written by D.L. Wheeler & Association, Inc. Daniel L. Wheeler, Professional Surveyor during the month of June 2002. Being the same property conveyed unto James Pillo and Heather Pillo, husband and wife, from Juliana C. Pillo, by deed dated the 19th day of June, 2002, and recorded in the office of the Clerk of the County Commission of Harrison County, West Virginia, in Deed Book No. 1340, at Page No. 1133. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
