NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 31, 2001, executed by the Borrower(s), William D. Boyles and Jacqueline M. Boyles, to Janet Phillips, the Trustee, of record in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Book 923, at Page 400. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1243 Norma Lane, Shinnston, WV 26431. Pill & Pill, PLLC was appointed as Substitute Trustee by APPOINTMENT OF SUCCESSOR TRUSTEE dated September 12, 2025, of record in the Clerk’s Office in Book 1538, at Page 235. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Harrison County, in Clarksburg, West Virginia, on the following date: November 12, 2025, at 3:27 p.m. All that certain lot or parcel of land situate in the City of Shinnston, Clay District, Harrison County, West Virginia, being lot Nos. 62, 63, and 64 as shown on a plat of “Long Heights Addition, Revision No. 1, Revision No. 2” recorded in Deed Book 1042, at pages 94 and 95, and more particularly described as follows: Beginning at a point at the intersection of Norma Lane and South Street, being the northwesterly corner of Lot No. 62; thence with Norma Lane and the front lines of Lot Nos. 62, 63, and 64 S 77 27′ E 150 feet to a point; thence S 12 33′ W 110 feet to a point in the northerly line of a 14-foot alley; thence with said alley and the rear lot lines of Lot Nos. 64, 63, 62 N 77 27′ W 150 feet to a point at the intersection of said South Street and said alley; thence with South Street N 12 33′ E 110 feet to the point of beginning, containing 16,500 square feet, more or less. Map/Parcel 1010-0032 By fee simple deed from Dennis C. Fowler and Beverly A. Fowler, his wife as set forth in Book 1207 Page 564 dated 8/15/1990, Harrison County Records, State of West Virginia. The said parties of the second part, by accepting this deed, covenant and agree that said property shall not be used for any commercial purpose for a period of twenty (20) years from the first day of April 1968 and, as owner of any other lot in said “Long Heights Addition, Revision No. 1; the forgoing restriction and condition shall operate as covenants running with the land, and a breach thereof may be enjoined, abated or remedied by appropriate proceedings by the grantor, its successors or assigns, or by any such owners, their heirs, assigns, or successors. There is reserved and excepted from the operation of this conveyance unto the party of the first part, it successors or assigns, and the owner or owners of lots or parcels of land in “Long Heights Addition, Revision No. 1, a map or plat of which Addition is of record in the proper office of Harrison County, West Virginia, in Deed Book No. 944, at page 602, the necessary easements and right-of-way in, under and across the property herein conveyed, to lay, construct, erect, repair, maintain, replace, or remove gas, sewer, water, electric, telephone lines, together with the rights and privilege to lay and construct additional lines: said lines shall be buried in the ground or erected and constructed across said property in such a manner that they will cause the minimum interference with travel over, through and across said property and shall be laid or constructed as near as may be reasonable practicable to the division lines of said property and the surface shall be replaced over said lines as to substantially conform with the contour of the surface prior thereto; together with the right of ingress and egress to fully enjoy said easement and rights-of-way. This deed is further made subject to all reservations, exceptions, covenants and conditions contained or referred to in prior deeds or other instruments of record affecting or pertaining to the property hereby conveyed. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
