NOTICE OF TRUSTEE SALE OF VALUABLE REAL ESTATE Pursuant to the authority vested in the undersigned by deed of trust dated the 4th day of June, 2003, signed by William G. Stimeling, Jr., to Jenny N. Phillips, Trustee State Director of the Rural Housing Service for the State of West Virginia, which said deed of trust is of record in the Office of the Clerk of the County Commission of Upshur, West Virginia, in Trust Deed Book 387 at page 19, and Golden & Amos, PLLC, Trustee having been requested so to do by the Secured Creditor, and default having been made under the terms and conditions of said deed of trust, and the provisions in said deed of trust concerning acceleration having been complied with by the Secured Creditor and present holder of the note, said Trustee will sell at public auction at 10:00 o’clock a.m. on the 5th DAY OF NOVEMBER 2025 at the front doors of the Courthouse in Upshur County in Buckhannon, West Virginia located at 40 W Main Street, Buckhannon, WV 26201, the following described real estate located in the District of Buckhannon Corporation, County of Upshur, State of West Virginia as follows: All of that certain lot, tract or parcel of land and the appurtenances thereto belonging, situate on the north side of Cleveland Avenue in the North Buckhannon (Hudkins) Addition, to the City of Buckhannon, Buckhannon Corporation District, Upshur County, West Virginia, bounded and escribed as follows: Beginning at a stake on the north side of Cleveland Avenue, the southwest corner of Lot 54 on Cleveland Avenue of the North Buckhannon (Hudkins) Addition to the City of Buckhannon, as delineated upon a plat of said North Buckhannon (Hudkins) Addition, recorded in the Office of the Clerk of the County Commission of Upshur County, West Virginia, in Plat Book 1 at page 7; thence in a northerly direction with the western boundary line of said lot 54, approximately 115 feet to the corner of the lot that was conveyed by the Buckhannon Building and Loan Association, a corporation, to Maurice Cutright, by deed dated October 22, 1940, and recorded in said Clerk’s Office in Deed Book 100 at page 459;thence in an easterly direction with the southern boundary line of said Cutright lot, 66 feet to lot 56 on said Cleveland Avenue; thence in a southerly direction with the western line of said Lot 56 approximately 115 feet to Cleveland Avenue; thence in a westerly direction with the north line of said Cleveland Avenue 66 feet to the beginning, and being the lot fronting 66 feet on the north side of Cleveland Avenue and running back therefrom in a northerly direction approximately 115 feet of said Lot 54 on Cleveland Avenue. The property herein conveyed is the same tract conveyed by Charles E. Wood to William G. Stimely, Jr., by deed date May 20, 2003, to be recorded in the Office of the Clerk of the County Commission of Upshur County, West Virginia. There is excepted and reserved from the aforesaid property all of the coal, oil and gas in and underlying the same together with the necessary mining and renewal rights, as the same have heretofore been excepted and reserved or conveyed away by the present or former owners. This conveyance is made subject to all existing reservations, restriction, exceptions, conditions, easements, rights of way or other servitudes, if any, made, reserved or created in prior deeds of record in said Clerk’s Office, or which would be disclosed by a visual inspection of the premises. For the stated consideration, the Grantor does further grant and convey unto the Trustee all rights of way and easements, together with all appurtenances pertaining to the aforesaid real estate, whether presently owner or hereinafter acquired, which are matter of record in said Clerk’s office of otherwise. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 54 Cleveland Avenue, Buckhannon, WV 26201 TERMS OF SALE: Cash in hand on day of sale or within 30 days of date of sale upon terms to be agreed upon between Trustee and successful bidder, time being of the essence; payment for unpaid real estate taxes to be assumed by the purchaser. The Trustee does not warrant title or fitness to this property; it is being purchased as is; this is a buyer beware sale and any buyer is advised to retain counsel before the sale. If there is any part of the process of sale which is found to be objectionable, the Trustee reserves the right to cancel the sale. No purchaser should take possession or make improvements in the premises until the Trustee deed is delivered or recorded. A third party purchaser at sale will be required to pay the purchase price plus all recording and transfer fees. Trustee at sale is under no duty to cause any existing tenant or person occupying the subject property to vacate said property. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. The party(ies) secured by the Deed of Trust reserve the right to purchase the property at such sale. If the purchaser at sale is unable to complete the terms of purchase within 30 days, the Trustee reserves the right to transfer the property to the next highest bidder. Any sale hereunder may be adjourned from time to time without any notice other than oral proclamation at the time and place appointed for this sale or by posting of a notice of same. Should the Trustee not appear at the time appointed for the sale and there is no notice posted of a continuance please contact the office of the Trustee to make further inquiry. Any sale may be conducted or adjourned by the designated agent or attorney of the Trustee. The undersigned is fully vested with the authority to sell said property as Trustee by instrument of record.
