AN ORDINANCE AND ORDER DETERMINING THE NECESSITY FOR AND PROVIDING FOR A SPECIAL LEVY FOR FISCAL YEARS BEGINNING JULY 1, 2028, JULY 1, 2029, JULY 1, 2030, JULY 1, 2031 AND JULY 1, 2032, TO PROVIDE FUNDS FOR THE SUPPORT, MAINTENANCE AND OPERATION OF THE KINGWOOD PUBLIC LIBRARY AND PURCHASE OF BOOKS AND SUPPLIES THEREFORE, AND TO PROVIDE FUNDS FOR THE SUPPORT, MAINTENANCE AND OPERATION OF KINGWOOD PARKS AND RECREATION, AND FOR THE CITY OF KINGWOOD, FOR MATERIAL AND REPAIRS TO STORM SEWERS AND FOR PAVING OF CITY STREETS, AND PROVIDING FOR AN ELECTION FOR SAID PURPOSES TO BE HELD ON May 12, 2026. ORDINANCE: An assessment of a levy for the support of the Kingwood Public Library, Kingwood Parks and Recreation, and City storm sewers and paving of streets. The City Council of the Municipality of Kingwood, Preston County, West Virginia, being of the opinion that the maximum levies for current expenses authorized by law will not provide sufficient funds for the support, maintenance and operation of the Kingwood Public Library and the purchase of needed supplies and books, nor will it provide for the sufficient funds for the support, maintenance and operation of the Kingwood Parks and Recreation, nor will it provide sufficient funds for materials and repairs to storm sewers and paving of City streets, and that an election should be held to raise sufficient sums for said purposes by a special levy effective for the five fiscal years, beginning July 1, 2028, and that such election should be held on May 12, 2026, as provided in Chapter 11, Article 8, Sections 16 and 17 of the West Virginia Code, as amended. It is therefore ORDERED and ORDAINED by the Council of the City of Kingwood, West Virginia, in regular session assembled, as follows: 1. That the purpose for which additional funds are needed for each of the fiscal years beginning July 1, 2028, and the ensuing five years thereafter, is for the support, maintenance and operation of the Kingwood Public Library and the purchase of books and supplies, and further for the support, maintenance and operation of the Kingwood Parks and Recreation, and for materials and repairs to storm sewers and paving of City streets. 2. That the amount needed for each purpose is as follows: KINGWOOD PUBLIC LIBRARY (a) Purchase of Books, Audio, and Periodicals $19,470.00 (b) Salaries and Staff benefits $63,895.00 (c) Utilities $9,912.00 (d) Insurance $1200.00 (e) Maintenance and Repairs $7,782.00 (f) Supplies, furniture, and equipment $4,549.00 TOTAL: $106,808.00 KINGWOOD PARKS AND RECREATION (a) Salaries $30,680.00 (b) Utilities $9,440.00 (c) Insurance $9,440.00 (d) Maintenance & Repairs $7,080.00 (e) Supplies $2,360.00 TOTAL $59,000.00 CITY OF KINGWOOD STORM SEWERS and STREET PAVING (a) Maintenance & Repairs and Street Paving $70,800.00 3. The total amount necessary for all of said purposes for the Kingwood Public Library is as follows for each year: $106,808.00; or a total of $534,040.00 for five years. The total amount necessary for all of said purposes for the Kingwood Parks and Recreation is as follows for each year: $59,000.00; or a total of $295,000.00 for five years. The total amount necessary for all of said purposes for the City of Kingwood Storm Sewers and Street Paving is as follows for each year: $70,800.00; or a total of $ 354,000.00 for five years. The total amount necessary for all of said purposes for the Kingwood Public Library, the Kingwood Parks and Recreation and the City of Kingwood is as follows for each year: $236,608.00; or a total of $ 1,183,040.00. 4. The total amount received from this levy shall be distributed among these purposes as aforestated for the amounts and purposes each year for the Kingwood Public Library, the Kingwood Parks and Recreation and the City of Kingwood. Any excess levy funds received in any fiscal year over and above the stated amount for each separate entity shall be paid to the City of Kingwood to provide additional funds to meet the purposes aforestated in accordance with the discretion for appropriation by the Council of the City of Kingwood. 5. The separate and aggregate assessed valuation of each class of taxable property within its jurisdiction for each of the following years is as follows: 2028-2029 Class II $63,535,573.00 Class IV $69,912,384.00 Aggregate $133,447,957.00 The proposed additional rate of levy in cents per hundred dollars of assessed valuation on each class of property is as follows: Class I 6-1/4 cents Class II 12-1/2 cents Class IV 25 cents 6. That the proposed number of years to which the additional levy shall apply are the fiscal years beginning July 1, 2028 July 1, 2029, July 1, 2030, July 1, 2031, and July 1, 2032. 7. That the local levying body will not issue bond. 8. That the question of such additional levy shall be submitted to a vote at an election to be held on May 12, 2026. 9. That the notice of such additional levy and of said special election shall be given by the publication of this order, as a Class II-O legal advertisement, in the territory in which the election is held, said notice to be published within fourteen (14) consecutive days next preceding the election. All provisions of the laws concerning general elections shall apply so far as they are practicable. 10. That the ballot to be used at such election shall be entitled and printed as follows: “Special election to authorize additional levies for each fiscal year beginning July 1, 2028, 2029, 2030, 2031, and 2032 for the purpose of support, maintenance, and operation of the Kingwood Public Library and the purchase of books and supplies therefor, and for the purpose of support, maintenance and operation of the Kingwood Parks and Recreation, and the City of Kingwood for materials and repairs to storm sewers and City Street paving according to the order of the Council of the City of Kingwood, entered on the __ day of ___ 2025”. The additional levy shall be on Class I property, 6-1/4 cents; Class II property, 12-1/2 cents; and Class IV property, 25 cents.
