TO: THE CITIZENS OF THE CITY OF PADEN CITY

N O T I C E

YOU ARE HEREBY DULY NOTIFIED that pursuant to
West Virginia Code §8-12-5, as amended, and Part
Nine, Chapter One, Article 906, entitled Unused Roads,
Streets, Alleys and Travel Ways of the Codified
Ordinances of the City of Paden City, West Virginia,
shall consider the application of landowners, Ronald L.
Cain, Karen K. Cain, and Frank Giovinazzo, to close,
vacate and abandon an unused travel way, known as a
portion of Tyler Street in Paden Park Addition situate
between South 3rd Avenue and South 4th Avenue, also
known as State Route 2, in Paden City, Tyler County,
West Virginia more specifically described as follows:

Tax Map 3, Parcel 134.1 identified as Lot 40 and Tax
Map 3, Parcel 134.2 identified as Lot 41 in a deed,
dated January 3, 2020, from Karen Bond to Ronald L.
Cain and Karen Kay Cain, recorded in Official Record
17, at page 47.

Tax Map 3, Parcel 134.4, identified as Lots 42 and 43 in
a deed, dated October 7, 2015, from Bernadine Joan
Farley to Ronald Cain, recorded in Deed Book 504 at
page 624.

Tax Map 3, Parcel 134.3 identified as Lot 44 and Tax
Map 3, Parcel 132 identified as Lots 10 and 11 in a
deed dated, March 5, 2021, from Joseph David
Giovinazzo to Frankie Lee Giovinazzo, recorded in
Official Record 147, at page 160.

Tax Map 3 Parcel 130 identified as Lot 12 in a deed,
dated September 30, 1988, from Frederick Michael
Doran and Mary Kathryn Doran to Ronald L. Cain and
Karen K. Cain, recorded in Deed Book 294, at page
689.

The City of Paden City will hold a public hearing on the
1st day of December, 2025, at 6:45 o’clock p.m. in
Council Chambers in the Paden City Municipal Building,
208 W. Main Street, Paden City, West Virginia, at which
time and place the Common Council will hear evidence
relating to the use of and rights or claims in or to Tyler
Street, Paden City, Tyler County, West Virginia. All
citizens wishing to address the Common Council will be
given an opportunity to be heard and to make any
proper legal defense, after which Council may make its
order pursuant to law, which may include closing and
vacating the aforesaid street and alley or portions
thereof.
