Plaintiff, Judith Mancino Tossone, filed with this Court, a civil action, seeking to quiet title of a parcel of real estate by adverse possession. Said parcel is identified by the Marion County Sheriff as being Parcel 60, on Tax Map 2, in Union City District.
TO: The above-named Defendant, that being Michael Close: It appearing that the Defendant has not been located by the Plaintiff for personal service, it is hereby Ordered that Defendant, named herein, serve upon John R. Funkhouser, Counsel for Judith Mancino (Tossone), whose address is 1708 Locust Avenue, Fairmont, West Virginia, and file with the Circuit Clerk for Marion County, West Virginia, an answer, including any related counterclaim or defense you may have to the complaint filed in this civil action on or before thirty (30) days from the date of this publication. If you fail to do so, thereafter judgment, upon proper hearing and trial, may be taken against you for the relief demanded in the complaint. A copy of said complaint can be obtained from the undersigned Clerk at her office.
