IN THE MATTER OF OHIO COUNTY CASE # 24-JA-136 ABBIGALE MCWHORTER, biological mother of infant L.B., whose date of birth is September 13, 2024, and ELIJAH BURCH, biological father of infant L.B., whose date of birth is Septemner 13, 2024, natural child of Abbigale McWhorter.
The Petitioner, the West Virginia Department of Human Services, has filed a petition alleging that ELIJAH BURCH has abused and neglected, abandoned, or failed to provide for the care, custody and control of L.B., whose date of birth is September 13, 2024. It is ORDERED that ELIJAH BURCH is to appear in the courtroom of the Honorable David J. Sims, Judge of the Circuit Court of Ohio County, West Virginia, Fifth Floor, Ohio County Courthouse, Wheeling, WV on the 9th day of December, 2025 at 1:00 p.m. for a Disposition Hearing if he so desires to object or make other defenses to the Petition; otherwise the parental rights of ELIJAH BURCH, biological father of infant L.B., whose date of birth is September 13, 2024, may be terminated.
