NOTICE OF SUBSTITUTE TRUSTEE’S SALE NOTICE IS HEREBY GIVEN that the undersigned Substitute Trustee, by virtue of the authority vested in her by that certain Deed of Trust, dated August 25, 2011, duly recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Trust Deed Book No. 1223, at page 1046, wherein Joshua T. Cogar did convey unto John D. Martin, II, Trustee, certain real property described in said Deed of Trust; and the undersigned Substitute Trustee appointed by Virtue of that Removal of Trustee and Appointment of Substitute or Successor Trustee recorded on November 12, 2024 in the aforesaid Clerk’s Office in Deed of Trust Book No. 1522 at page 1; and default having been made in the payment of the aforesaid indebtedness, and the undersigned Substitute Trustee having been requested in writing so to do by the Lender, Harrison County Bank, the owner and holder of said note, the undersigned Substitute Trustee, will on, Monday, December 8, 2025, AT 10:00 A.M. OFFER FOR SALE AND SELL AT PUBLIC AUCTION at the front door of the Harrison County Courthouse located at 301 West Main Street, Clarksburg, WV, to the highest bidder, the following real estate, to wit: All those two certain lots or parcels of land situate in the Town of Lost Creek, Grant District, Harrison County, West Virginia, more particularly described as follows: FIRST LOT: Part of that lot or parcel of land marked and designated as Lot No. 38 on that certain plat or plan of lots called A. D. Bassel Second Addition to the Town of Lost Creek, which plat is of record in the office of the Clerk of the County Commission of Harrison County, West Virginia in Deed Book No. 218, at page 316. There are excepted and reserved from the aforesaid lot or parcel of land the following: 1) Part of Lot No. 38 which was conveyed by E. V. Allman to Everett L. Miller by deed dated September 1, 1930, and of record in Deed Book No. 418, at page 398. 2) Part of Lot No. 38 which was conveyed by E. V. Allman to Everett L. Miller by deed dated April 16, 1934, and of record in Deed Book No. 453, at page 206. SECOND LOT: Lot No. Thirty-nine (39) on that certain plat or plan of lots called A. D. Bassel’s Second Addition to the Town of Lost Creek, and of record in the office of the Clerk of the County Commission of Harrison County, West Virginia in Deed Book No. 218, at page 316. LSOT: Deed Book 1476, Page 90, dated July 25, 2011. The above-described real estate is reported to have a 911 address of: 12 Broadway Street, Lost Creek, WV 26385. TERMS OF SALE: The Real Property will be sold for cash in hand on the date of sale, or under any different, other, or additional sale terms as the Successor Trustee, in his or her reasonable discretion, determines to be appropriate or advisable. The sale shall be further subject to the following: 1. The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s office or affecting the subject property. 2. All real estate taxes delinquent, currently due, or hereafter due will be the responsibility of the buyer. 3. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 4. The Beneficiary/and or the Servicer of the Deed of Trust and Note reserves the right to submit a bid for the property at sale. 5. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6. In the event that there are federal tax liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. 7. The undersigned Successor Trustees expressly reserve the right to reject any and all bids, and the right to adjourn the sale from time to time without notice other than oral proclamation at the time and place appointed for the sale. Such adjournment may be for a period of time deemed expedient by the beneficial owner and shall not be construed to be a waiver of the right to make the sale contemplated by this Notice. 8. The successful bidder will be required to execute a memorandum of sale upon the acceptance of the successful bid by the Successor Trustee. 9. Buyer will be required to deposit 10% of bid on the day of the sale (the “Good Faith Deposit”), in the form of cash or a cashier’s check payable to BesTitle Agency Inc., with the balance to be paid in cash at closing within 30 days after the date of sale. 11.
