NOTICE OF TRUSTEE’S SALE
By virtue of the execution of a certain deed of trust
dated April 17, 2020, recorded in the Office of the Clerk
of the County Commission of Tyler County, West
Virginia, in Official Record Book 25, page 630, made
and executed by, Cody D. Todd to Timothy R. Aiken,
trustee, to secure Union Bank, Inc. in the payment of the
deed of trust obligation therein fully set forth, and Logan
Hassig, whose principal residence is Wetzel County, West Virginia, having been appointed as Successor
Trustee by “Appointment of Successor Trustee
Agreement” recorded in the aforesaid Clerk’s Office in
Substitute Trustee Book 377, page 334, and the said
Trustee having been required by the said beneficiary so
to do, the undersigned Trustee will sell said property to
the highest and best bidder at the front door of the
courthouse in Tyler County, West Virginia, at
Middlebourne, West Virginia, on
Wednesday, December 3, 2025 at 10:00 a.m.
Said deed of trust property, with the appurtenances
thereunto belonging, situate in Tyler County, West
Virginia, and is more particularly described as follows,
to-wit:
The following described real estate particularly
described as follows:
Situate in Union District, Tyler County, West Virginia, on water tributaries of the Ohio River and east of the
Village of Friendly on the north of West Virginia
Secondary Road 6, and more particularly bounded and
described as follows:
BEGINNING at a point in the northern right-of-way of
West Virginia Secondary Road 6, north of the centerline
by 20 feet, a stake called for but not found, set a 1-1/2
inch x 36 inch iron pipe a corner to E. L. Robinson, thence with the northern right-of-way for said W. Va.
Secondary Road 6 for two lines S 75 55′ W 235.89 feet
to a point of curve to the right and concave to the
northeast, thence Westerly along said curve 115.57
feet, (chord distance N 75 50′ W 110.92 feet) said curve
having a radius of 117.89 feet to a re-bar in a 6 inch
concrete monument, a corner to W. C. Bell thence
leaving said road and with said Bell for two lines N 39 47′ E 150.40 feet to a re-bar in a 6 inch concrete
monument, thence N 50 25′ W 83.51 feet to an electric pole, corner to said Bell, and in a line of F. Deaton, thence with said Deaton and a cyclone fence for one
line and a 10 foot right-of-way for a gas line for part of a
line N 40 24′ E. passing the end point of a 10 foot gas
line right-of-way at 76.3 feet, in all 109.31 feet to a 2
inch iron pipe (found) a corner to said Deaton and in a
line of W. Rice, thence with said Deaton and in a line of
W. Rice, thence with said Rice for two lines S 43 24′ E
88.52 feet to a 2 inch iron pipe (found), thence N 50 19′
E 247.48 feet to a point south of a 10 foot driveway for
said Rice and a corner to said Rice and in a line of D. L.
Statler, set a 1-1/2 inch x 36 inch iron pipe from which a
1 inch iron pipe was found by a fence post corner to the
Friendly Cemetery bears N 23 00′ W 22.66 feet, thence
with said Stateler for one line S 23 00′ E 157.02 feet to
a 1-1/2 inch galvanized iron pipe set in a 6 inch concrete
monument (found) in a lien of said Statler and a corner
to said E. L. Robinson, thence with said Robinson for
two lines S 53 24′ W 132.26 feet to a 6 inch concrete
monument (found), thence S 16 26′ E 96.00 feet to the
beginning, containing 1.82 acres, more or less, as
surveyed in September- October, 1979 by Mark C.
Echard, Land Surveyor of Glenville, West Virginia, and
as shown on a plat of survey of record in the office of
the Clerk of the County Commission of Tyler County,
West Virginia, in Deed Book 224, at pages 54 and 55,
which is incorporated herein by reference.
The herein described property is subject to a right-of-way 10 ft. in width and 76.3 ft. in length, for
William C. Bell and Marjie R. Bell, his wife, their heirs, successors and assigns, to remove, maintain and repair an existing gas line, as shown upon the aforesaid plat of survey.
Being the same property that was conveyed unto Cody David Todd by Jennifer Ann Jackson, et al. by Deed dated the 27th day of December, 2019 and of record in the Office of the Clerk of the County
Commission of Tyler County, West Virginia in Official Record Book 5, at page 512.
This conveyance is made subject to any and all
exceptions, reservations, restrictions and conveyances
heretofore given, granted, leased, reserved and
excepted by the party of the first part and his
predecessors in title.
TERMS OF SALE:
1. The property is being conveyed in an “AS IS”
physical condition by Deed containing no warranty,
express or implied, subject to the Internal Revenue
Service right of redemption, all property taxes, prior
Deeds, liens, reservations, encumbrances, restrictions,
rights of way, easements, covenants, conveyances and
conditions of record in the said Clerk’s Office or
affecting the subject property.
2. The purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-22-1.
3. The beneficiary and/or the servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4. The Trustee reserves the right to continue the sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole
discretion of the Trustee.
5. The Trustee shall be under no duty to cause an
existing tenant or person occupying the property to
vacate said property, and any personal property and/or belongings remaining at the property after the
foreclosure sale will be deemed to constitute
ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6. The total purchase price is payable to the Trustee by certified or cashier’s check on the day of sale.
