CIVIL ACTION NO: 25-C-84 ORDER OF PUBLICATION To: The abovenamed Defendant Carolyn Sipe The object of the above entitled action is for the purpose of seeking an Order from the Court that the subject property owned by Defendant be ordered and decreed to be re-mediated and that an Order be entered to allow a contractor may enter upon the lands in question at all times necessary to remedy the deficiencies mentioned in the Complaint in this matter, that the lands be subjected to a lien for said costs, sold, if necessary, and after payment of costs, including Plaintiff’s attorney fees, and that the Plaintiff be reimbursed for the same before distribution of funds to Defendant, and that other, and further, relief as to the Court seems to fit and proper, the Defendant being the alleged owner of said lands. It appearing that by affidavit filed in this action in regard to said Defendant Sipe, that the Plaintiff has used due diligence to ascertain the residence or whereabouts of said Defendant, without effect, and that process, delivered to the Sheriff of the County in which the Defendant resides or is, has twice been delivered to such officer and has been returned without being executed, it is accordingly Ordered that the Defendant appear and serve upon G.W. Morris, II, Plaintiff’s counsel, whose address is P O Box 329, Weston, WV 26452, an answer or other defense to the complaint filed herein on or before the 31st day of December, 2025, otherwise, judgment by default may be taken against them at any time thereafter. A copy of said complaint can be obtained from the office of the undersigned Clerk of this Court at his office in the Upshur County Courthouse, in Buckhannon, Upshur County, West Virginia.
