The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 19, 2012, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19483369, in Book No. 1448, at Page 526, Edward J Burkle and Sara Jarrell did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wilmington Savings Fund Society, FSB, as Owner Trustee of the Residential Credit Opportunities Trust IX- A to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 10 – Wheeling District, Ohio County, West Virginia, and more particularly described as follows:
Situated in the City of Wheeling, Ohio County, West Virginia, more particularly described as follows: Beginning at a rebar set on the westerly line of Reilly Street, as shown on the Plat of Subdivision of the Reilly Farm, on record in the Office of the Clerk of the County Court of Ohio County, West Virginia, in Deed Book No. 57, pages 361 and 362, at a point where said line intersects the northerly line of land conveyed to The Ohio Valley Steel Company by instrument recorded in the Office of said County Clerk in Deed Book 656, page 622. Thence, from the said point of beginning, South 89 23′ 30″ West 242.17 feet, with the said northerly line of the Ohio Valley Steel Company, passing a rebar set at 222.95 feet to the easterly line of Wetzell Street, formerly known as William Street;
Thence, North 15 35′ 30″ East 42.01 feet, with the easterly line of Wetzell Street, to a point thereon; Thence, with the southeasterly line of a roadway, with a record width of 18 feet, the following four courses; 1) North 57 08′ 30″ East 38.76 feet; 2) North 22 20′ 30″ East 76.96 feet; 3) North 43 32′ 30″ East 46.91 feet; 4) North 54 22′ 00″ East 24.05 feet to a rebar set;
Thence, South 70 56′ 30″ East 168.93 feet, with a line of Rockpoint Limited Liability Company’s Parcel One as recorded in the Office of the County Clerk in Deed Book 717, page 545, to a rebar set on the westerly line of said Reilly Street;
Thence, therewith, South 19 03′ 30″ West 130.09 feet, to the point of beginning.
The above described tract contains 0.7891 acre.
Being the same premises known as Parcel No. 1 in the conveyance to Matthew Nickolas as recorded in Deed Book 779, page 130 in the Office of the Clerk of the County Court of Ohio County, West Virginia.
Subject to any pertinent rights, privileges, easements, or restrictions of record.
The rebars set are 1/2 inch in diameter and 30 inches in length, set flush to the ground and topped with a plastic cap embossed “AJ SMITH WV-809”. The bearings used herein are based on prior deed and survey records. Being the same property which was heretofore conveyed to Edward J. Burkle and Sara Jarrell by Edward J. Burkle by a Deed the 24th day of October, 2008, and recorded in the aforesaid County Clerk’s office in Deed Book No. 789, at page 45.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 1704 Wetzel St, Wheeling, WV 26003.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $3500.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
