NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated December 17, 2021, executed by Borrower(s), Johnathan Landis, to Chris Eller, the Trustee of record in the office of the Clerk of the County Commission of Harrison County, West Virginia, in Book 1467, at Page 1198. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1293 Flag Run Rd, Clarksburg, WV 26301. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 10, 2025, of record in the Clerk’s Office in Book 1541, Page 479. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Harrison County, in Clarksburg, West Virginia, on the following date: January 14, 2026, at 3:15 p.m. All of that certain tract or parcel of land, together with the appurtenances thereunto belonging, situate on or near the waters of Flag Run, Sardis District, Harrison County, West Virginia, and more particularly bounded and described as follows: Beginning at a beech stump, which stump is in the easterly line of the Flag Run Road where the Flag Run Road crosses the boundary line between the property herein conveyed and property belonging to Archie C. Strother and running thence in a westerly direction 8 rods to a stone; thence in a southwesterly direction 20 rods to a stone; thence in an easterly direction 10 rods to a stone in the easterly line of the Flag Run Road; thence with the easterly line of the Flag Run Road in a northeasterly direction 20 rods more or less, to the place of beginning, containing three-fourths (3/4) of an acre, more or less. There is EXCEPTED and RESERVED from this conveyance, however, the garden tract belonging to the Harbert Heirs, being more particularly bounded and described as follows: BEGINNING at a point in the westerly line of the Flag Run Road, which point is in a southeasterly direction 32.5 feet from the initial corner heretofore described; thence in a southwesterly direction 76 feet to a stone; thence in a southeasterly direction 127 feet to a stone; thence in a northeasterly direction 72.5 feet to the westerly line of the Flag Run Road; thence with the Flag Run Road in a northeasterly direction 130 feet, more or less, to the place of beginning. And being the same real estate conveyed to Joseph A. Mikes by Laura Snider, widow, by deed dated February 24, 2006, and recorded in Deed Book 1389 at Page 183 in the Office of the Clerk of the County Commission of Harrison County, West Virginia. TRACT NO. 2: All that certain lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate on or near the waters of Flag Run, in Sardis District, Harrison County, West Virginia, being more particularly bounded and described as follows: BEGINNING at a stake located 32.5 feet east of a beech tree on the east side of the County Road, thence S. 75-1/4 W. 76 feet to a stone, thence S. 14-1/2 E. 127 fee to a stone, thence N. 76-1/2 E. 72.5 feet to the middle of County Road, thence North along said County Road to the point of beginning, containing 9,429.75 square feet, more or less. And being the same real estate conveyed to Joseph A. Mikes by Nila J. Glover, widow, by deed dated August 7, 1997, and recorded in Deed Book 1290 at Page 868 in the Office of the Clerk of the County Commission of Harrison County, West Virginia. The property also includes manufactured housing unit as follows: 2008 CMH 36M030 with Serial Number: CWP018606TNAB. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
