NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated July 3, 2013, executed by the Borrower, Kevin Butcher, a single man, to Vance Golden, Attorney, the Trustee, of record in the Office of the Clerk of the County Commission of Lewis County, West Virginia, in Book 400, at Page 607. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 341 Hidden Meadows Ln., Jane Lew, WV 26378. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated December 1, 2025, of record in the Clerk’s Office in Book 481, at Page 54. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Lewis County, in Weston, West Virginia, on the following date: January 14, 2026, at 12:30 p.m. All that certain tract, lot or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Hacker’s Creek District, Lewis County, West Virginia, and being more known as Lot No. Nine (9) of Hidden Meadows Subdivision, being more particularly described as follows: Beginning at a 3/4″ rebar, set corner to Lot 10 and in the outside line of the parent tract of which this is a part, thence with said outside line, S. 33-03-20 E. 182.97 feet to a 3/4″ rebar, set; thence S. 63-16-50 W. 208.32 feet to a 3/4ths inch rebar set, corner to Lot No. 8; thence leaving the outside line of the parent tract and with Lot No. 8, N. 59-13-30 W. 144.36 feet to a 8-inch Elm, corner to Lot 6; thence with Lot 6 N. 59-45-40 W. 86.09 feet to a 3/4ths inch rebar, set; thence N. 41-19-30 W. 192.95 feet to a 3/4th inch rebar, set on the limits of a 30-foot right of way; thence with the limits on a curve to the left having a long chord distance of 62.40′ and with an arc length of 69.31′ to a 3/4ths inch rebar, set in the line of Lot 10; thence N. 87-38-20 E. 99.96 feet with Lot 10 to a 3/4ths inch rebar, set; thence N. 89-44-20 E. 59.68 feet to a 3/4ths inch rebar, set; thence S. 71-38-00 E. 233.03′ feet to the place of beginning, containing 2.17 acres, designated as Lot No. 9 of Hidden Meadows Subdivision as shown upon a plat thereof of record in the Office of the Clerk of the County Commission of Lewis County, West Virginia, in Deed Book 564 at page 105, together with the right in conjunction with others to use Meadow Drive, as ingress and egress to this land on a 30-foot right of way. The aforesaid tract was conveyed to Kevin B. Butcher and Sherry L. Butcher by William R. Atchison and Sharon A. Atchison by deed dated November 8, 2006, recorded in said Clerk’s Office in Deed Book 611 at page 847. And further conveyed by deed dated June 28, 2013, recorded in said Clerk’s Office in Deed Book 670 at page 111 whereby Sherry L. Butcher conveyed all of her undivided 1/2 interest in and to the subject property to Kevin B. Butcher. There is excepted and reserved from the aforesaid property all of the coal, oil and gas in, upon and underlying the same together with the necessary mining and removal rights, as the same have heretofore been excepted and reserved or conveyed away by the present or former owners. This conveyance is made subject to all existing reservations, restrictions, exceptions, conditions, easements, rights of way or other servitudes, if any, made, reserved or created in prior deeds of record in said Clerk’s office, or which would be disclosed by a visual inspection of the premises. For the stated consideration, the Granter does further grant and convey unto the Trustee all rights of way and easements, together with all appurtenances pertaining to the aforesaid real estate, whether presently owned or hereinafter acquired, which are matters of record in said Clerk’s office or otherwise. TERMS OF SALE: 1)The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale Should any party have inquiries, objections to the sale or protests regarding the sale, or requests regarding the sale, please notify the Trustee below by one of the means of communication set forth below.
