NOTICE OF SALE UNDER DEED OF TRUST Default having been made in the payment of that certain note and debt secured by that certain deed of trust, executed by Jackie D. Scarff, which deed of trust is dated December 26, 2018, and recorded in the Office of the Clerk of the County Commission of Lewis County, West Virginia, in Trust Deed Book 437 page 216, and demand for sale having been made by the beneficiary and holder of the note and debt secured thereby, to-wit: Calhoun County Bank, Inc.; notice is hereby given that on the 21st day of January, 2026, at 2:00 o’clock P.M., the undersigned, Substitute Trustee, Mark H. Reed, will offer for sale at public auction to the highest bidder thereof, at the front door of the Courthouse at Lewis County, West Virginia, subject to the reservations, exceptions and provisions hereinafter mentioned, described or referred to, the following described real estate, together with the improvements thereon and the appurtenances thereunto belonging, being more particularly described as follows: All those certain lands, subject to the reservations, exceptions and provisions hereinafter mentioned, described or referred to, together with the buildings and improvements thereon and the appurtenances thereunto belonging, including any manufactured structures, mobile homes, double wide or modular homes, lying and being situate near the town of Jane Lew on the waters of Hackers Creek District, Lewis County, West Virginia, and being more particularly bounded and described as follows, to-wit: Tract No. 1 Beginning at a 1/2″steel pin, a common corner with Lot No. 3 and a point in the line of F. The said Lillie Corrine Scarff died October 3, 2011, record found in Death Record Book No. 18 at page 169, in the aforesaid Clerk’s Office. By operation of law, Jackie Dale Scarff is the sole owner of said property. Tract No. 2 An undivided one-half (1/2) interest in and to the certain 0.045 acre tract situated as aforesaid, together with the non-exclusive right of way or easement for purposes of ingress, egress and regress on, over and across the aforesaid parcel of real estate, to be used together with the owners of Lot No. 3, their heirs and assigns, and for the purposes of a road way and utility right of way, said 0.045 acres tract being more particularly bounded and described as follows: Beginning at an iron pipe marking the north corner of Lot 4 and east corner of Lot 3, thence with two lines of Lot 3, N. 06 47′ W. a distance of 25.02 feet; N. 31 28′ E. a distance of 39.51 feet to the northeast corner to Lot 3; thence leaving said Lot 3, S. 63 44′ E. a distance of 25.96 feet to a point in the west right of way line of Orchard Street; thence S. 11 17′ W. a distance of 32.67 feet; thence S. 21 05′ W. a distance of 28.0 feet to the northeast corner of Lot 4; thence with a north line of Lot 4, N. 65 35′ W. a distance of 26.88 feet to the place of beginning, containing 0.045 acres, more or less. There is reserved from this conveyance a permanent utility and drainage easement for the purpose of utility lines and their accessories, other lines for water, sewage, natural gas, as well as drainage lines and such other utility lines and drainage lines as may be required; said easement is described as follows: Beginning at a point in the southern line of Lot No. 4, said point being located as follows: Beginning at the southwestern corner of Lot No. 4, thence S. 64 34′ E. 20 feet, thence S. 64 34′ E. 15 feet to a point, thence N. 25 11′ E. 100 feet, thence N. 64 34′ W. 15 feet to a point in the division line of Lots Nos. 3 and 4, thence S. 25 11′ W. 100 feet to the place of beginning. Being the same real estate conveyed unto Jackie Dale Scarff and Lillie Corrine Scarff by Garton Real Estate and Construction, Inc., a West Virginia Corporation, by deed dated August 28, 1985, of record in the Office of the Clerk of the County Commission of Lewis County, West Virginia in Deed Book 442 at page 224. The said Lillie Corrine Scarff died October 3, 2011, record found in Death Record Book No. 18 at page 169, in the aforesaid Clerk’s Office. By operation of law, Jackie Dale Scarff is the sole owner of said property. There is permanently situated on the aforesaid tract a certain mobile home, to-wit: 2014, Clay FH, CLH036584TNAB, which mobile home is permanently attached to and incorporated as a part of said real estate. Said manufactured home will be sold as part of the property. This conveyance is made subject to all existing reservations, restrictions, exceptions, conditions, easements, rights of way or other servitudes, if any, made, reserved or created in prior deeds of record in said Clerk’s office, or which would be disclosed by a visual inspection of the premises. This sale is made subject to, and where applicable, the Purchaser herein shall have the benefit of the exceptions, reservations, rights of way, easements and provisions contained in the foregoing deeds of record. This sale is further made subject to any and all terms of any other deeds constituting the chain of title. The aforesaid tract, and sale thereof, are subject to rights of way or easements and all prior reservations, exceptions, restrictions and agreements affecting the premises which are of record in said Clerk’s Office or which would be disclosed by a careful inspection of the premises and any unpaid real estate taxes.
