TRUSTEE’S SALE
Notice is hereby given, by virtue of the authority vested in the undersigned Successor Trustees, Luke T. Schmitt and L. Elizabeth King, by that certain Commercial Real Estate Deed of Trust made Chilson A. Gaudreau and Kimmy L. Gaudreau, September 3, 2014, and recorded September 5, 2014, in the office of the Clerk of the County Commission of Hancock County, West Virginia in Trust Deed Book 831, at page 924, the said Successor Trustees acting by virtue of that certain Appointment of Successor Trustee dated May 22, 2025, and recorded July 18, 2025, in the aforesaid Clerk’s office in Trust Deed Book 906, at page 2187, and default having been made in the payment of the Note secured by the aforesaid Deed of Trust, and having been requested in writing by the owner and holder of the Note, will offer for sale, at public auction, to the highest bidder at the front door of the Courthouse of Hancock County, West Virginia, on Tuesday, January 20, 2026 at 12:00 p.m. all that certain lot, piece or parcel of real property, together with improvements thereon, situate in Weirton, Butler District, Hancock County, West Virginia, being more particularly bounded and described as follows:
Located in the City of Weirton, In Butler District, in Hancock County, West Virginia, and being the residue of the lands conveyed to Chilson A. & Kimmy L. Gaudreau, in Vol 192, pg 267, and Vol 216, pg 328, and being then, lots 105 and 106, of C.F. Fergusons First Allotment to the City of Weirton as recorded in Plat Bk 1, Page 120, and 121, and now being a portion of the same, and being now known as Lot 3, as shown on the Plat of the Subdivision of Lot 105 and 106, as recorded in the Office of the Clerk at Plat Slide 53-A, and being more particularly described as follows:
Beginning at a railroad spike found at the intersection of the north line of Ferguson Avenue, and the west line of a 20 ft. alley which lies between Orchard Street and West Street, and marking what was formerly, the SE corner of Lot 106 of D.F. Ferguson’s First Allotment, as recorded in Plat Book 1, page 120 and 121, and is now the SE corner of Lot 3, as shown on the Plat of the Subdivision of Lot 105 and 106, as recorded in the Office of the Clerk at Plat Slide 53-A, and also marking the SE corner of the parcel here-in described.
Thence with the north line of said Ferguson street, N87 30’00″W 64.190 ft. to a Mag Nail set on the edge of a concrete apron, marking the SE corner of Lot 1 of said Subdivision of Lot 105, and 106, as recorded in the Office of the Clerk at Plat Slide 53-A, and marking the SE corner of the tract conveyed to Good Shepard Properties in Vol 285, pg 518, and also marking the SW corner of said Lot 3 of said subdivision, and thereby marking the SW corner of the parcel here-in described.
Thence, leaving the street, and with the common line between the aforementioned Lots 1 and 3, N2 30’00″E 40.000 ft. to a 1/2″ iron pin found, marking a point on the southerly line of Lot 2 of said subdivision, and also marking a point on the southerly line of the tract conveyed to John Carpenter as recorded in O.R. Vol 824, pg 313, and also marking an angle point on the westerly boundary of said Lot 3, and thereby marking an angle point on the westerly boundary of the parcel here-in described.
Thence with the boundary of said Lot 2 and with the boundary of the tract conveyed to said John Carpenter, the following two bearings and distances;
1. S87 degrees 30’00″E. 9.900 ft. to a 5/8″ diameter x 30″ long iron pin set bearing a plastic cap marked V. Dowdle PS #2012, (here-in after called a 5/8″ CIP), marking the SE corner of said Carpenter tract.
2. N2 degrees 30’00″E 40.000 ft. to a 1/2″ iron pin found in a chainlink fence, marking a point on the southerly line of Lot 104, of the aforementioned C.F. Fergusons First Allotment to the City of Weirton, and also marking the NE corner of said Lot 2, and the tract conveyed to said John Carpenter, and also marking the NW corner of said Lot 3, and thereby marking the NW corner of the parcel here-in described
Thence with the common line between the aforementioned Lot 104, and what was formerly Lot 105, and with the northerly lien of said Lot 3, S87 degrees 30’00″E 54.290 ft. to a 5/8″ CIP set on the west line of the aforementioned 20 ft. alley, and marking the SE corner of said Lot 104, and the NE corner of said Lot 3, and thereby marking the NE corner of the parcel here-in described.
Thence with the west line of said alley, S2 degrees 30’00″W 80.000 ft. the place of beginning, containing 0.1088 acres, more or less, and subject to all legal highways, rights of way, and/or easements, leases and options, and subject to any and all conditions and/or restrictions, and/or reservations and/or exceptions as may be applicable, and to all applicable zoning regulations, or ordinances.
The basis for bearings is the south line of the Subdivision of Lot 105 and 106, as found monumented, as recorded in the Office of the Clerk at Plat Slide 53-A, and being N87-30 W.
This description from a field survey conducted on August 13, 2014, by Vincent Dowdle P.S. #2012 a plat of which was made and filed at the mapping office, and any interpretation of the information with-in this description should not be made with-out the inclusion of the information and notes on said plat, said survey being subject to any facts that may be disclose din a full and accurate title search.

Subject to any and all prior records, including, but not limited to, any and all coal, oil, gas, and/or mineral rights reserved, excepted, conveyed or leased.
Being a part of the property conveyed to Chilson A. Gaudreau and Kimmy L. Gaudreau by deed of Chilson P. Gaudreau and Shirley Ann Gaudreau dated October 24, 1983 and of record in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Deed Book 192, at page 267. Also, being a part of the property conveyed to Chilson A. Gaudreau and Kimmy Lee Gaudreau by Deed of Dan Enich, single, and Nick Enich, Jr. and Debbie Enich, husband and wife, dated February 22, 1991 and of record in the Office of the Clerk of the County Commission of Hancock County, West Virginia in Deed Book 216, at page 328.
At the time of execution of the deed of trust, the grantors represented that the address of the property was 216 Ferguson Avenue, Weirton, WV 26062.
TERMS OF SALE: The Premises will be sold “AS IS, WHERE IS,” in its present condition and with all faults and defects, if any. The property will be conveyed by deed with no covenants of warranty of title. The property shall be sold subject to all liens not discharged by the sale, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges and liens with priority to the Deed of Trust pursuant to which this sale is being conducted. The property shall be sold subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s office or visible upon the ground. The high bidder must pay 10% of its bid immediately following the sale, and the high bidder must pay the remaining balance due on or within 14 days following the date of the sale.
In addition to the payment of the bid, the purchaser of the property at the sale shall be responsible for paying a 10% buyer’s premium to Joe R. Pyle Complete Auction & Realty LLC immediately at the conclusion of the auction. This buyer’s premium is in addition to the winning bid amount.
The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamps to be affixed to the deed). The Successor Trustees and United Bank, Inc., shall not be responsible for the removal of any person or personal property from the Premises.
Pursuant to the Deed of Trust, the Successor Trustees may postpone the sale by public announcement at the time and place designated and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the Premises at such sale.
