The object of the above-entitled action is a civil matter brought by Plaintiff to collect monies owed by Defendants.
And it appearing by Affidavit filed in this action that service of process of a cross-claim was directed to Defendants Kara Corp,, Laurie Glenz and Alfred Glenz pursuant to Rule 4(c)(2) and Rule 4(c)(3)(A), of the West Virginia Rules of Civil Procedure, to no effect, and it further appearing from said Affidavit that Defendant, Kurt Zende, has made reasonable and diligent attempts to serve these Defendants with process, to no effect, accordingly
It is ORDERED that said Defendants do serve upon Gerald E. Lofstead III, Esq., Attorney for Defendant Kurt Zende, whose address is P.O. Box 831, Wheeling, WV 26003, an Answer or other defense to the cross-claim filed in this action on or before thirty (30) days from the date of first publication, otherwise judgment by default will be taken against said Defendants at any time thereafter. A copy of said Defendant Kurt Zende’s Answer and Cross-Claim can be obtained from the undersigned Clerk at her office.
