NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustees, Richard A. Pill and David D. Pill, by that certain Deed of Trust dated August 31, 1999, executed by the Borrower(s), Angela H. Roscoe and Antonio J. Roscoe, to Phyllis H. Arnold of Kanawha County & Brian J. Fox, the Trustees, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 683, at Page 22. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of Rt. 1 Box 342B, Farmington, WV 26571, and, upon information and belief, may now be known as 62 Harrington Ln., Farmington, WV 26571. Richard A. Pill and David D. Pill were appointed as Substitute Trustees by a Substitution of Trustee dated October 1, 2007, of record in the Clerk's Office in Book 909, at Page 760. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

February 18, 2026, at 4:38 p.m.

All of that certain parcel or lot of land situate in West Augusta (Lincoln) District, Marion County, West Virginia, and more particularly bounded and described as follows:

Beginning at a 1/2" iron pin found, corner to Michael and Amy Roscoe (DB 915-859); thence with one line of the same N. 29° 42' 49" W. 200.00 feet to a 1/2" iron pin set in line of Michael and Amy Roscoe; thence with four arbitrary lines through Michael and Dorothy Roscoe N. 50° 39' 27" E. 523.61 feet to a 1/2" iron pin set; thence S. 35° 06' 16" E. 320.00 feet to a 1/2" iron pin set; thence S. 45° 25' 32" W. 448.89 feet to a 1/2" iron pin set; thence N. 67° 17' 14" W. 184.37 feet to the place of beginning, containing 4.05 acres, as shown on a map or plat of said property titled "Plat of 4.05 Acres to accompany Deed to Antonio J. Roscoe, Lincoln District, Marion County, West Virginia, Scale 1" = 100', December 1997, Paul D. Harbert, PS No. 862, McCoy Surveying Company, Inc., Monongah, West Virginia,", a copy of which is of record in the office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 946, at Page 710, reference to which is hereby made.

Being the same real estate conveyed to Antonio James Roscoe by Michael Roscoe and Dorothy T. Roscoe, husband and wife, by Deed dated April 24, 1998, of record in the aforesaid Clerk's office in Deed Book No. 946, Page 707.

Grantors also convey herein a 25 foot right of way over existing driveway to WV Sec. Rt. 15/8 and a 20 foot right of way as shown on the plat recorded aforesaid over the property of the Grantors as a means of ingress and egress to and from said property conveyed herein. The right of way contained herein shall be permanent and run with the land and shall also be of the benefit of the heirs, successors or assigns in title of the Grantees. This conveyance is expressly made and accepted subject to all of the reservations, exceptions, restrictions, covenants, agreements, easements, rights of way, conditions, and limitations of record under and by which Grantors are bound in the ownership of the real estate herein conveyed insofar and insofar only as same are now in force and effect.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
