TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated December 17, 2018, and duly recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia, in Document No. 19690036, in Book No. 1575, at Page 360, Joshua C Dent did convey unto Zagula Law Offices, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated October 4, 2019, and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Mortgage Solutions of Colorado, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Ohio County Courthouse in Wheeling, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Clearview District, Ohio County, West Virginia, and more particularly described as follows:

The following tract of land situate on the Northerly side of Clearview Avenue (formerly called Reilly – Delaplain Road), Clearview, Richland District Ohio County, West Virginia, comprising a part of Parcel 5 as shown on the Assessor’s Map CV6, and being more particularly bounded and described as follows:

Beginning at an iron pin set in the Northerly line of Clearview Avenue at the Southeast corner of the hereindescribed tract, said pin also being the Southeast corner of the 2 and 416/1000 acre tract of land (of which the hereindescribed is a part), that was conveyed by David M, Campbell, single, et al, to Woodrow G. Miller and Dorothy E. Miller, his wife, by deed dated December 10, 1965 and recorded in the Office of the Clerk of the County Commission of Ohio County, West Virginia in Deed Book 471, at page 166; thence from said beginning pin and with said Northerly line of S. 62* 28′ W. (based on the meridian of Plat Book 2, at page 41, hereinafter mentioned), 90 feet to an iron pin set at the Southeast corner of lands of Herndon (Deed Book 843, page 326); thence with same and then with other lands of Reinacher (Deed Book 908, page 315), N.28* 15′ W. (passing iron pins set at 75 feet, 150 feet, 225 feet and 450 and 95/100 feet), 484 feet to an iron pin set at the Southwest corner of 1 and 42/100 acre tract of land remaining to the party of the first part hereto; thence with same N. 62* 28′ E. 90 feet to an iron pin set in the Westerly line of lands now or formerly Campbell (Deed Book 437, page 198); thence with same S. 28* 15′ E. (passing iron pins set at 33 and 47/100 feet, 169 feet, 309 feet, and 339 feet), 484 feet to the place of beginning, containing by survey made by Stegman & Schellhase, Inc., Civil Engineers and Surveyors, on November 28, 2018, One (1) acre, more or less, and shown on the map attached hereto for reference purposes.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 197 Clearview Ave, Wheeling, WV 26003.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
