The object of the above-entitled action is to quiet title in and to a certain oil and gas estate located in Marion County, West Virginia, being more specifically described as the natural gas in and underlying a certain tract of land containing 15 acres, more or less, located in Mannington District, Marion County, West Virginia, and as further described in the Complaint as the "Subject Tract," and to grant additional requested relief, as is more particularly described in the Complaint filed herein.
It appearing by Affidavit filed in this action that the Plaintiff has attempted to obtain service of the Complaint upon Defendants, Lora Lee Yoho Rinehart, Sharon Sue Yoho, Rose M. Snyder, Joyce F. Thomas, James H. Lemley, Rita Darlene Byard, Paul Isaiah Tennant, Heather Louise Ramsay, Kathryn Leigh Ramsay, Andrea Dawn Lovett, Michael Ross Valesky, Rebecca Anne Spencer, Neal Wayne King, Kimberly M. Norton, Pamela S. Smithie, Kaye Marie Morris, Christina J. Richardson, and Garrett A. Glover, by Secretary of State or certified mail, and that the Plaintiff has used due diligence pursuant to Rule 4(e)(1)(C) of the West Virginia Rules of Civil Procedure, to ascertain the addresses or whereabouts of the Defendants.
It is, therefore, ORDERED that LORA LEE YOHO RINEHART, SHARON SUE YOHO, ROSE M. SNYDER, JOYCE F. THOMAS, JAMES H. LEMLEY, RITA DARLENE BYARD, PAUL ISAIAH TENNANT, HEATHER LOUISE RAMSAY, KATHRYN LEIGH RAMSAY, ANDREA DAWN LOVETT, MICHAEL ROSS VALESKY, REBECCA ANNE SPENCER, NEAL WAYNE KING, KIMBERLY M. NORTON, PAMELA S. SMITHIE, KAYE MARIE MORRIS, CHRISTINA J. RICHARDSON, and GARRETT A. GLOVER appear and serve upon Michael C. Cardi, Bowles Rice LLP, counsel for Plaintiffs, whose address is 125 Granville Square, Suite 400, Morgantown, West Virginia, 26501, a response or other defense to the Complaint heretofore filed in this action within 30 days after the date of first publication of this notice. Otherwise, the Court may render a judgment of default against Defendants LORA LEE YOHO RINEHART, SHARON SUE YOHO, ROSE M. SNYDER, JOYCE F. THOMAS, JAMES H. LEMLEY, RITA DARLENE BYARD, PAUL ISAIAH TENNANT, HEATHER LOUISE RAMSAY, KATHRYN LEIGH RAMSAY, ANDREA DAWN LOVETT, MICHAEL ROSS VALESKY, REBECCA ANNE SPENCER, NEAL WAYNE KING, KIMBERLY M. NORTON, PAMELA S. SMITHIE, KAYE MARIE MORRIS, CHRISTINA J. RICHARDSON, and GARRETT A. GLOVER at any time thereafter, thereby granting the relief requested by Plaintiff in the Complaint.
