Case No. 25CV000139 Judge Margaret Evans NOTICE OF SERVICE BY PUBLICATION PURSUANT TO CIVIL RULE 4.4 Fred E. Fillinger, Jane Doe #1, Unknown Spouse, if any, of Fred E. Fillinger, Brent Sheets, and Jane Doe #2, Unknown Spouse, if any, of Brent Sheets, whose place of residence is unknown and cannot by reasonable diligence be ascertained, will take notice that on the 23rd day of October, 2025, Plaintiff, Peoples Bank, filed a Complaint for Foreclosure against Fred E. Fillinger, et al., in the Court of Common Pleas of Gallia County, Ohio, the same being Case No. 25CV000139, representing among other things that there is due from Fred E. Fillinger, on a Note the sum of $29,267.91, plus interest at the per diem rate of $2.30 from September 10, 2025, plus court costs, advances, and other charges as allowed by law; that as security for the payment of said Note, on August 12, 2016, Fred E. Fillinger and Joanne G. Fillinger (now deceased) executed a Mortgage to Peoples Bank, which was recorded on August 18, 2016, in Book 588, page 875, et seq., of the Official Records of Gallia County, Ohio; and thereupon became the first lien upon the real estate located at 47 Westwood Drive, Gallipolis, Ohio 45631 (Parcel No. 008-019-008-00) (the “Property”). Plaintiff, Peoples Bank, demands judgment on Count I of its Complaint in the amount of $29,267.91, plus interest at the per diem rate of $2.30 from September 10, 2025, plus court costs, advances, and other charges as allowed by law; that its mortgage be foreclosed and the liens marshaled; that the equity of redemption of the Defendants be foreclosed; that the Property be sold and the amount due the Plaintiff, Peoples Bank, be paid from the proceeds of said sale according to its priority, together with its costs therein, including reasonable attorney’s fees; and that all Defendants be required to set up their claims or interests in the Property, or be forever barred. Defendants above named and mentioned are required to answer the Complaint within twenty-eight (28) days after March 31, 2026, the date of the last publication of this notice, by serving a copy upon Robert A. DeBlasis, Esq., Kohnen & Patton LLP, Attorney for Plaintiff, 201 East Fifth Street, Suite 800, Cincinnati, Ohio 45202, and filing said Answer with the Clerk, Gallia County Common Pleas Court, Courthouse, 18 Locust Street, Room 1290, Gallipolis, Ohio 45631. Failure to answer or otherwise respond as permitted by the Ohio Rules of Civil Procedure within the time stated will cause a judgment by default to be rendered against you for the relief demanded in the Complaint for Foreclosure.
