RCRA Class 3 Permit Modification
The West Virginia Department of Environmental
Protection (DEP), Division of Water and Waste
Management, is providing public notice of intent to issue
a hazardous waste permit modification to MPM
Silicones, LLC to approve an increase in capacity for
one (1) land disposal unit. MPM Silicones, LLC is
located in Friendly, in Tyler County, West Virginia, at
latitude 39 29′ 05″ N and longitude 81 05′ 40″ W.
This permit will be issued under authority of West
Virginia Code, Chapter 22, Article 18.
The State of West Virginia is authorized to administer
and enforce a hazardous waste management program,
in lieu of the federal program for portions of the
Resource Conservation and Recovery Act of 1976 (RCRA), and the Hazardous and Solid Waste
Amendments of 1984 (HWSA). HWSA imposes
additional requirements on hazardous waste
management facilities that will be enforced by the U.S.
Environmental Protection Agency (EPA) until the State
of West Virginia receives authorization for those
requirements.
State law (Chapter 22, Article 18 of the W.Va. Code)
requires Beazer East, Inc. to have a permit for the
operation of its various unit(s). State law also requires
that DEP provide the public with an opportunity to
participate in the permitting process via public notice
and opportunity to request a hearing.
A copy of the administrative record, including the permit
application and draft permit will be available for review
at the DEP office located at 601 57th Street SE,
Charleston, WV 25304.
During the designated 45-day public comment period,
persons wanting to review any information should

to schedule an appointment. Any person desiring
site-specific or technical information should contact the

43803. Permit conditions are draft and open to public
comment. Persons wishing to comment on the draft
permit must submit their comments in writing to:

Relevant written comments received during this 45-day
comment period, on or before 4:00 pm on April 20th,
2026, will be considered in the final permitting decision.
Persons desiring a public hearing should send their
written request during the comment period, stating the
nature of the issue(s), to the DEP at the address noted
above. If a public hearing is warranted, the director will
provide the public with a notice of at least 30 days
prior to the scheduled hearing. Following the comment
period, the director will make the permitting decision.
If the terms and conditions of the permit remain
substantially unchanged from those announced by this
notice, the director will issue the permit and respond to
all persons who submitted written comments and to any
person who requested the response. If the terms and
conditions are substantially changed, the director will
offer the public an opportunity for review and comment
on substantial changes before the final permitting
decision.
