NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated November 30, 2005, executed by Borrower(s), Donald Lee Skavinsky and Brenda Sue Skavinsky, to Tommy Dixon, the Trustee of record in the office of the Clerk of the County Commission of Monongalia County, West Virginia, in Book 1432, at Page 433. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 45 Yew Street, Maidsville, WV 26541. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 31, 2025, of record in the Clerk’s Office in Book 2681, Page 1. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Monongalia County, in Morgantown, West Virginia, on the following date:
March 26, 2026, at 5:32 p.m.
All that certain property situated in the District of Cass, County of Monongalia and State of West Virginia, Lot #68, surface property of Brock, Incorporated, Cassville, being more fully described in Deed Volume 751 and Page 169, Map #17A and Parcel #80 as follows: All of Lot No. 68, as laid down and designated on the maps or plats of Surface Property of Brock, Incorporated, Cassville, Cass District, Monongalia County, West Virginia, which said maps or plats are of record in the office of the Clerk of the County Court of Monongalia County, West Virginia, in Deed Book 386, at Page 40, Deed Book No. 389, at Page 198, and Deed Book No. 390, at Page 242-A and 242-B. Being the same real estate conveyed to Charles Robert Lenhart and Joann Lenhart by William Nicknadavich and Anna M. Nicknadavich, his wife, by deed bearing date the 6th day of September, 1958, of record in the aforesaid County Clerk`s office in Deed Book No. 565, at Page 112, to which said maps and deed reference is here made for all pertinent purposes. This conveyance is made subject to all reservations, exceptions, restrictions, covenants, conditions and stipulations, and servitudes imposed upon said real estate by the Grantors` predecessors in title. There are further excepted from this conveyance all roadways and rights-of-way that are now being used for the benefit of adjacent property owners and the public.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.
7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
