TRUSTEE'S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated April 28, 2010, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 977, at Page 576, Nicholas L. Masters and Elizabeth A. Masters did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

March 26, 2026, at 4:40 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont City District, Marion County, West Virginia, and more particularly described as follows:

All the following described parcel of real estate, together with the appurtenances thereunto belonging, situate in the City of Fairmont, Fairmont City District, Marion County, West Virginia, and designated as Lot No. 85 as numbered and shown on a map or plat of "Peacock Park", recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book No. 247, at Page 140, and being more particularly described as follows, to-wit:

Beginning at an iron pin found in the western right of way line of Broadview Avenue and being the southeastern right of way line of Lot No. 86; thence with the line of said street, S. 11° 17' 00" E. 65.68 feet to an iron pipe found, being the northeastern corner of Lot No. 84; thence with the northern line of said lot, S. 78° 31' 17" W. 153.45 feet to an iron pipe found, being the northwestern corner of said Lot No. 84 and being in the eastern line of the Lavencheck tract; thence N. 12° 23' 16" W. 65.24 feet to an iron pipe found, being the southwestern corner of Lot No. 86; thence with the southern line of said lot, N. 78° 21' 19" E. 154.71 feet to the point of beginning, being all of Lot No. 85 of said Peacock Park Addition and containing 0.23 acres, more or less, a map or plat of which said real estate is recorded in the said Clerk's Office in Deed Book No. 946, at Page 165, which said map or plat is incorporated herein by reference for all pertinent purposes.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 146 Broadview Avenue, Fairmont, WV 26554.

AND BEING the same real estate which was conveyed to Nicholas L. Masters and Elizabeth A. Masters, by Deed dated April 6, 2009, from John Paul Gotses and Ellen J. Gotses, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1047, at Page 611.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
