TRUSTEE'S SALE OF
VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 1, 2021, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1278, at Page 1090, Kevin E. Smith did convey unto Funkhouser and Smith PLLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

March 26, 2026, at 4:33 PM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont District, Marion County, West Virginia, and more particularly described as follows:

All that certain lot or parcel of land, together with any and all improvements thereon and appurtenances thereunto belonging, situate in Meredith Springs, Fairmont District, Marion County, West Virginia, a more particular description of said tract being as follows:

BEGINNING at an iron pin in the original outlines of lands, owned by Mary Konya, widow and unremarried, and a common corner to Lot "F" of the same subdivision, and running with two lines of Lot "F" thence S. 31° 28' 26" E. 94.35 feet to an iron pin; thence S. 03° 04' 03" E. 137.51 feet to an iron pin; thence leaving Lot "F" and running S. 81° 36' 50" W. passing an iron pin corner to Lot "B" and Lot "D" at 49.39 feet and passing another iron pin corner to Lot "D" and Lot "E" at 189.50 feet for a total distance of 1,127.95 feet to a point in the line of lands presently owned by F.G.G. Conley and others; thence running with the Conley line, N. 03° 24' 10" W. 127.64 feet to a point in the original outline and common corner to lands of Harry P. and Vera B. Summers; thence with the line of said Summers and lands of Charles and Glenda Sconish, N. 76° 33' 50" E. 1096.87 feet to the point of beginning, containing 4.55 acres, and being the remainder of the 5,616 acre Lot "C" as shown on a plat prepared by Bernard G. Sampson Company, Engineers, Fairmont, West Virginia, dated April, 1952, and recorded in Deed Book 520, at page 119. Said property conveyed hereby is designated as "Revised Lot "C" as shown on "Plat Showing Property of Mary Konya, Widow." Prepared by the said Bernard G. Sampson Company, Inc. dated February, 1983, and attached to that deed dated the 24th day of February, 1983, and recorded in said Clerk's Office in Deed Book 845, at page 436.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 20 Bundy Lane, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Kevin E. Smith, by Deed dated June 30, 2021, from Susan M. Konya, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1285 at Page 540.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
