NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, Esq., by that certain Deed of Trust dated July 16, 2010, executed by the Borrower(s), Cora A. Wolfe and Roger L. Wolfe, to Richard A. Pill, Esq., the Trustee, of record in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Book 983, at Page 538. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of RR 2 Box 43, Fairmont, WV 26554, and, upon information and belief, may now be known as 1525 Pennsylvania Ave., Fairmont, WV 26554. The Borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Marion County, in Fairmont, West Virginia, on the following date:

March 26, 2026, at 4:36 p.m.

THE LAND REFERRED TO IN THIS POLICY IS SITUATED IN THE STATE OF WEST VIRGINIA, COUNTY OF MARION, AND DESCRIBED AS FOLLOWS:

PARCEL ONE (1): BEGINNING AT A POINT IN THE CENTER OF OHIO RIVER AND MARYLAND TURNPIKE ROAD, A COMMON CORNER TO EGRASS AND CARVILLANO AND RUNNING THENCE WITH THE CENTER OF SAID ROAD N. 9 DEGREES 30' E. 3 FEET TO A STAKE; THENCE N. 85 DEGREES 15' E. 396 FEET TO A STAKE; THENCE S. 9 DEGREES 30' W. 3 FEET, CORNER TO SAID PARTIES; THENCE S. 85 DEGREES 15' W. 396 FEET TO THE PLACE OF BEGINNING AND BEING A PARCEL OF LAND 3 FEET WIDE BY 396 FEET IN LENGTH. SEE PLAT IN DEED BOOK NO. 803 AT PAGE 797. THIS PARCEL WAS INCORRECTLY DESCRIBED IN PREVIOUS DEED AS: PARCEL ONE (1): BEGINNING AT A POINT IN THE CENTER OF OHIO RIVER AND MARYLAND TURNPIKE ROAD, A COMMON CORNER TO EGRASS AND CARVILLANO AND RUNNING THENCE WITH THE CENTER OF SAID ROAD N. 9 DEGREES 30' E. 3 FEET TO A STAKE; THENCE N. 85 DEGREES 15' E. 396 FEET TO A STAKE, CORNER TO SAID PARTIES; THENCE S. 85 DEGREES 15' E. 396 FEET TO THE PLACE OF BEGINNING AND BEING A PARCEL OF LAND 3 FEET WIDE BY 396 FEET IN LENGTH. SEE PLAT IN DEED BOOK NO. 803 AT PAGE 797.

PARCEL TWO (2): BEGINNING AT A STAKE IN THE CENTER OF THE OHIO RIVER AND MARYLAND TURNPIKE ROAD, CORNER TO THEODORE CHARLES EGRASS AND RUNNING THENCE N. 85 DEGREES 15' W. 396 FEET TO A STAKE; THENCE S. 9 DEGREES 30' W. 53 FEET TO A STAKE; THENCE SOUTHEASTERLY 396 FEET TO A STAKE IN THE CENTER OF SAID ROAD; THENCE WITH CENTER LINE OF SAID ROAD N. 9 DEGREES 30' E. 63 FEET TO THE PLACE OF BEGINNING.

BEING THE SAME PROPERTY CONVEYED TO ROGER L. WOLFE AND CORA A. WOLFE, HUSBAND AND WIFE, IN JOINT TENANCY BY DEED FROM HAL N. PLUMLEY AND MARGERY PLUMLEY, HUSBAND AND WIFE, DATED 11/17/2000, FILED 11/28/2010 AND RECORDED IN DEED IN BOOK 965, PAGE 235 IN MARION COUNTY RECORDS.

TERMS OF SALE:

1. The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2. The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3. The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4. The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5. The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6. The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
