The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated November 5, 2015, and duly recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Document No. 201500005327, in Book No. 839, at Page 171 and modified by Loan Modification Agreement recorded on October 15, 2019 in Document No. 201900004538 MOD, in Book No. 866, at Page 2628 and modified by Loan Modification Agreement recorded on August 28, 2024 in Document No. 202400004067 MOD, in Book No. 901, at Page 3994, Holly E Corning did convey unto Daniel J Guida, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Hancock County Courthouse in New Cumberland, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 06 – Weirton District, Hancock County, West Virginia, and more particularly described as follows:
Located in the District of Butler (now in Weirton District), County of Hancock and State of West Virginia:
Beginning at the intersection of the Southerly line of Steubenville and Pittsburgh Road (Cove Road) and the Westerly line of Orchard Avenue as shown on Plat of Rogers Park Addition Plat Book 2, Page 26 of the Records of the County Clerk of Hancock County, West Virginia, running thence, along the Westerly line of said Orchard Avenue S. 20 Degrees 30 minutes E. 630.0 feet to a point, said point being the intersection of the Westerly line of said Orchard Avenue and the Northerly line of a 30 foot Street, thence along the Northerly line of said 30 foot street S. 69 degrees 30 minutes W. 437.0 feet to a point, said point being the beginning to the Tract to be conveyed, running thence along the dividing line between Lots 15 and 16 N. 20 degrees 30 minutes E. 300.0 feet to a point, thence S. 69 degrees 30 minutes W. 100.0 feet to a point, thence S. 20 degrees 30 minutes E. 300.0 feet to a point in the Northerly line of said 30 foot street, thence along said line N. 69 degrees 30 minutes E. 100.0 feet to the place of beginning. Being Lot No. 16 J.A. Bowers Addition and containing 0.68 acres.
There is excepted and reserved from the above-described parcel of real estate, the following piece or parcel of land conveyed to Dewey J. Guida and Karen R. Guida, his wife, by Deed of Chester L. Cottrill and Georgia H. Cottrill, his wife, dated April 9, 1974, and of record in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Deed Book 157, at page 230, and by Corrective Deed dated May 23, 1974, of record in Deed Book 158, at page 18, described as follows:
All of that certain part of lot or parcel of land situated in the City of Weirton, District of Butler (now in Weirton District), County of Hancock, and State of West Virginia, known and designated as being the North one-half of Lot No. 16, of the “J. Bowers Plan,” said plan of lots being recorded in Plat Book No. 1, Page 229, and more particularly described as follows:
Beginning at a point which is the corner of Dickson Street and an unnamed, unimproved 30 foot right-of-way also being the southwest corner of Lot No. 16 of the “J. Bowers Plan”, thence N. 20 degrees 30 minutes W. 150.0 feet to true place of beginning of the parcel to be conveyed; thence N. 20 degrees 30 minutes W. 150.0 feet to a point; thence N. 69 degrees 30 minutes E. 100.0 feet to a point being the Northwest corner of Lot No. 15; thence S. 20 degrees 30 minutes E. 150.0 feet to a point; thence S. 69 degrees 30 minutes W. 100.0 feet to the place of beginning, containing .34 acres, more or less.
Also the grantors hereby grant to the grantees, their heirs and assigns, a right-of-way 10 feet wide for the construction, maintenance and replacement of a sanitary sewer line over, across, and under the South portion of Lot No. 16.
At the time of the execution of the Deed of Trust, this property was reported to have an address of: 101 Dickson St, Weirton, WV 26062.
The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: $5000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.
FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
