NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 8, 2015, executed by Borrower(s), Larry F. Ennis and Mary Ennis, to Michael J. Bell, the Trustee of record in the office of the Clerk of the County Commission of Mason County, West Virginia, in Book 418, at Page 0043. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 5456 Mt Union Rd, Fraziers Bottom, WV 25082. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated December 12, 2022, of record in the Clerk’s Office in Book 494, Page 771. The Borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Moore (new survey) and the parcel herein being described; thence with the line of T. Moore and this parcel along an old fence in part S. 56 01 16″ W. 277.3 feet to an iron pin (set) in the division line between Parcel (2) Two and vacant lands of Bradshaw; thence with the West line of Parcel (2) Two, N. 7 38` 12″ W. 484.52 feet to an iron pin (set) in the South right of way limits of the aforesaid Mount Union Road, and containing 1.818 acres, more or less, and as shown on that certain map of record in the Office of the Clerk of the County Commission of Mason County, West Virginia in Deed Book 365 at Page 159. And being the same property conveyed to Larry F. Ennis and Mary Ennis, from Autumn Walker, formerly known as Autumn Hightower, and Pansy L. Spencer, by deed dated July 8, 2015, and recorded in Deed Book 422 at Page 773 in the Office of the Clerk of the County Commission of Mason County, West Virginia. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention.
