Lumberport, WV 26386 And it appearing by an affidavit filed in this action that THE PLAINTIFF REQUESTS THE FOLLOWING RELIEF FROM THE COURT: THE PLAINTIFF, REVERSE MORTGAGE SOLUTIONS, INC. BRINGS THIS MATTER BEFORE THE MAGISTRATE COURT PURSUANT TO THE CIVIL JURISDICTION GRANTED THE COURT BY WEST VIRGINIA CODE 50-2-1 WHICH STATES IN PERTINENT PART THAT “MAGISTRATE COURTS SHALL HAVE JURISDICTION OF ALL MATTERS INVOLVING UNLAWFUL ENTRY OR DETAINER OF REAL PROPERTY…” THE PLAINTIFF PURCHASED THE REAL ESTATE OF BY VIRTUE OF TRUSTEE FORECLOSURE SALE AND IS ENTITLED TO FULL AND COMPLETE POSSESSION OF THE PREMISES FREE OF ANY RIGHT THE DEFENDANT(S) MAY HAVE. THE DEFENDANT(S) WAS PROPERLY NOTIFIED OF THE AFOREMENTIONED FORECLOSURE SALE, PURSUANT TO WEST VIRGINIA CODE 38-1-4, BY VIRTUE OF A NOTICE BEING SERVED ON THE DEFENDANT(S) BY CERTIFIED MAIL AS DIRECTED BY THE CODE. WEST VIRGINIA CODE 38-1-4 PROVIDES THAT “…NOTICE SHALL BE DEEMED COMPLETE WHEN SUCH NOTICE IS MAILED TO THE AFORESAID ADDRESS, NOT WITHSTANDING THE FACT THAT SUCH MAIL MAY BE RETURNED AS REFUSED OR UNDELIVERABLE…” FURTHERMORE, NOTICE OF THE SALE WAS PUBLISHED, PURSUANT TO WEST VIRGINIA CODE 38-1-4. THE DEFENDANT(S) HAS NO AGREEMENT FOR POSSESSION OF THE PREMISES WITH PLAINTIFF. THE DEFENDANT(S) UNLAWFULLY WITHHOLDING FROM THE PLAINTIFF THE POSSESSION OF THE PREMISES, GIVING RISE TO THIS COMPLAINT PURSUANT TO WEST VIRGINIA CODE 55-3-1. THE DEFENDANT(S) IS ALSO LIABLE TO PLAINTIFF FOR ANY DAMAGES TO THE PREMISES OF WHICH THEY ARE THE PROXIMATE CAUSE WHILE THE DEFENDANT(S) IS IN WRONGFUL POSSESSION OF THE PREMISES. WHEREFORE, THE PLAINTIFF REQUESTS POSSESSION TO THE ABOVED-DESCRIBED PROPERTY AND, IF ANY, THE FOLLOWING ADDITIONAL RELIEF FROM THE COURT: THE DEFENDANT(S) BE EJECTED OR EVICTED FROM THE PREMISES BY DIRECTING THE SHERIFF TO REMOVE THE DEFENDANT(S) ON A DATE CERTAIN. THAT THE DEFENDANT(S) BE REQUIRED TO ANSWER OR MAKE APPEARANCE AS IN AN ACTION FOR UNLAWFUL ENTRY AND DETAINER UNDER 50-4-5. it is ordered that Charles E. Dawson do serve upon KIMBERLY WYGAL, magistrate, whose address is 306 WASHINGTON AVENUE, CLARKSBURG, WV 26301, an answer or other defense to the complaint filed in this action on or before 30 DAYS FROM THE FIRST PUBLICATION DATE, otherwise judgment by default will be taken against Charles E.
