IN RE: APPLICATION OF THE CITY OF FAIRMONT FOR THE ANNEXATION BY MINOR BOUNDARY ADJUSTMENT OF A CERTAIN PARCEL OR TRACT OF REAL ESTATE CONSISTING OF 9.63 ACRES, MORE OR LESS, SITUATE ON OR NEAR CARRIAGE DRIVE, FAIRMONT DISTRICT, MARION COUNTY, WEST VIRGINIA.
ORDER OF PUBLICATION AND NOTICE OF PROPOSED
ANNEXATION
On the 11th day of March, 2026, at 10:00 a.m., at a regular session of the County Commission of Marion County, West Virginia, came the City of Fairmont and presented its application for permission to annex by minor boundary adjustment that certain territory consisting of 9.63 acres, more or less, situate entirely in Fairmont District, Marion County, West Virginia, which territory is more particularly bounded and described in the âBoundary Description of a Proposed Annexation for the City of Fairmontâ prepared by Bradley C. Pigott, WVPE No. 2223, and as depicted on a map or plat prepared by George E. Pigott & Associates, Inc., dated December 23, 2021, copies of which are attached hereto and made a part hereof.
The Commission upon a review of said application finds said application to be in proper form, and the Commission, being satisfied that said application meets the threshold requirements for consideration as a minor boundary adjustment outlined in West Virginia Code §8-6-5 and that neither West Virginia Code §8-6-2 or §8-6-4 provide an efficient or cost effective manner of annexation in this instance, is of the opinion to and does hereby ORDER that a public hearing be held on said proposal and that notice of the public hearing be published and posted according to law.
It is therefore ORDERED that the public hearing upon the proposed annexation as set forth in the application be set before this Commission for April 8, 2026, at 10:30 a.m., in Commission Chambers, 4th Floor, J. Harper Meredith Building, 200 Jackson Street, Fairmont, Marion County, West Virginia.
It is further ordered that this ORDER together with the attached description shall be published as a Class II-0 Legal Advertisement in compliance with the provisions of West Virginia Code §59-3-1, and that the publication area shall be the City of Fairmont and the territory sought to be annexed and that the first publication be at least fourteen days prior to the public hearing, and that this ORDER together with the attached description shall be prominently posted at not less than five (5) public places within the territory proposed to be annexed.
