NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated June 2, 2025, executed by Borrower(s), Jonathon Arden McGlothlin, to Robert D. Fisher, the Trustee of record in the office of the Clerk of the County Commission of Mason County, West Virginia, in Book 516, at Page 680. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 80 Blain Ln, Gallipolis Ferry, WV 25515. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated February 19, 2026, of record in the Clerk’s Office in Book 524, Page 410. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mason County, in Point Pleasant, West Virginia, on the following date: 22nd day of April, 2026 at 11:00 a.m. All of those certain lots, tracts or parcels of real estate, situate, lying and being in Clendenin District, Mason County, West Virginia, more particularly bounded and described as follows: Parcel One: BEGINNING at a stake in the Southerly outline of Blain Lane, situate at the Northwesterly corner of Lot No. 1 of Blain Subdivision; thence with the Southerly outline of Blain Lane in a Westerly direction 114 feet to a stake; thence in a Southerly direction parallel with the Westerly line of Lots No. 1 and 2 of Blain Subdivision 119.7 feet to a stake in the Holland line; thence in an Easterly direction with the Holland line 114 feet to a stake in the Westerly line of Lot No. 2 of Blain Subdivision; thence in a Northerly direction with the Westerly line of Lot No. 2 and 1 of Blain Subdivision 119.7 feet to the place of beginning, containing .33 acre, more or less. Reference is made to the map and plat of Blain Subdivision recorded in the office of the Clerk of the County Commission of Mason County, West Virginia, in Plat Book No. 3 at Page 21 for use in locating said real estate. Parcel One, is the same real estate conveyed unto Michael Lindsay Eddy and Nita Drane Eddy, during their natural lives as joint tenants and not as tenants in common, and upon the death of either, to the survivor thereof, in fee simple, by Donald W. Fowler and Irene L. Fowler, his wife, by deed dated September 8, 1993, and of record in the office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 318 at Page 451. Thereafter, by deed dated March 17, 2003, of record in the aforesaid Clerk`s office in Deed Book 367 at Page 609, Michael Lindsay Eddy and Nita Diane Eddy, his wife, conveyed the herein described real estate unto Benny R. DeWeese and Teri J. DeWeese. Parcel Two: ALL of that certain lot, tract or parcel of real estate, estimated to contain a parcel 41 feet wide and 107 feet deep, containing by estimation 0.10 acre, more or less, being a conveyance in gross and not by the acre. Parcel Two, is the same real estate conveyed unto Evelyn M. Edwards by L. W. Getty, Clerk of the County Commission of Mason County, West Virginia, by deed dated the 1st day of April, 1972, and of record in the office of the Clerk of the County Commission of Mason County, West Virginia, in Deed Book 226 at Page 78. Evelyn M. Edwards died testate and by her will dated June 30, 1997, of record in the aforesaid Clerk`s office in Will Book 34 at Page 22, devised the real estate herein conveyed unto William E. Edwards. William E. Edwards died testate and by his will dated June 30, 1997, of record the aforesaid Clerk`s office in Will Book 34 at Page 26, devised the real estate herein conveyed unto Eleanor Edwards. Eleanor Edwards died testate and by her will dated April 13, 1999, of record in the aforesaid Clerk`s office in Estate Book 5 at Page 370, directed the Executor of her Last Will and Testament to sell and convey the aforesaid real estate. Thereafter, by deed dated May 23, 2005, of record in the aforesaid Clerk`s Office in Deed Book 378, page 326, Larry D. Edwards, Executor under the Last Will and Testament of Eleanor Edwards, deceased, conveyed the above described real estate unto Benny DeWeese and Teri DeWeese. Thereafter, by deed dated May 2, 2025, and recorded in the aforesaid Clerk`s Office in Deed Book 482, at Page 562, Benny DeWeese and Teri DeWeese, husband and wife, conveyed the above described real estate to Jonathon Arden McGlothlin. A plat of Parcel Two, prepared by Delbert F. Bratcher, LPS, dated June 1, 2004, is of record in the aforesaid Clerk`s Office in Slide 199A, stating said parcel contains 0.03 acre, more or less. This conveyance is subject to the following restrictive covenants for the Blain Subdivision: 1.There shall not be any buildings constructed on any lot in said Subdivision costing less than Fifty-Five Thousand and no/100 ($55,200.00) Dollars. 2.There shall not be any sale of intoxicating liquors or non-intoxicating beer on any lot in said Subdivision. 3.These covenants and conditions shall be effective for a period of Fifty (50) years from the last day of January, 1956, and will automatically be renewed for an additional period of fifty (50) years unless a majority of the then owners of the said lots in said Subdivision file a written termination of said covenants and conditions within one (1) year after the end of said original period of fifty (50) years. This conveyance is made subject to all oil, gas and other mineral reservations as made by predecessors in the chain of title and to all valid and existing rights of way and easements and any and all restrictive and protective covenants appearing of record. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Pursuant to the Financial Crimes Enforcement Network’s Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements. 7) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
