The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated July 16, 1999, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 820, at Page 420, and re-recorded in Deed of Trust Book 853, at Page 76, Richard A. Limbach did convey unto Stephen R. Kershner, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at 400 West Stephen Street, in Martinsburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Opequon District, Berkeley County, West Virginia, and more particularly described as follows:
All that certain parcel of real property, with the improvements thereon and the appurtenances thereunto belonging, situate in the Opequon District, Berkeley County, West Virginia, designated and described as follows:
Parcel One: Beginning at an iron pin (1) corner to M. Kenneth Ring and William M. Ring and in the westerly line of W. Va. S. R. C. Route 45/5; thence with said Ring S. 61 deg. 30′ W. 225 feet to an iron pin (2); thence S. 28 deg. 30′ E. 100 feet to an iron pin (3) corner to Laurie Pratt Robertson, et ux.; thence with said Robertson N. 61 deg. 30′ E. 225 feet to an iron pin (4) corner to said Robertson and in the westerly line of said W. Va. S. R. C. Route 45/5; thence with the westerly line of said W. Va. S. R. C. Route 45/5 N. 28 deg. 30′ W. 100 feet to the point of beginning (1), containing an area of 0.516 acre, as shown on a plat thereof made by V. L. Tetlow, Registered Professional Engineer, attached to a Deed recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 232, at Page 590.
Parcel Two: “Beginning at (209) a point corner to Robert G. and Dana Grover Smiles tract and in the center of a 40′ right of way and in the westerly right of way line of W. Va. Sec. Route 45/5; thence with W. Va. Sec. Route 45/5 the following courses: S. 28 deg. 17′ 36″ E. 50.196′ to (22) a 1/2′ iron pipe found in the westerly right of way line of W. Va. Sec. Rte. 45/5 and corner to Davis R. and Nancy Grove; thence leaving the said W. Va. Sec. Rte. 45 and with the Grove tract the following course: S. 61 deg. 55′ 29″ W. 172.219′ to (214) a 5/8″ recap and cap set or to be set in the line of the above mentioned Grove tract and corner to George W. and Anna J. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 2112 Eagle School Road, Martinsburg, WV 25401 N/K/A 2314 Eagle School Rd., Martinsburg, WV 25404.
AND BEING the same real estate which was conveyed to Richard A. Limbach, by Deed dated July 16, 1999, from Paul B. Langert and Susan C. Langert, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 626, at Page 86.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
