NOTICE OF TRUSTEE'S SALE

NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated October 29, 2009, executed by Borrower(s), Anthony Scyphers, to BB&T Collateral Service Corporation, the Trustee of record in the office of the Clerk of the County Commission of Mercer County, West Virginia, in Book 1177, at Page 613. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 100 New Ridge Rd, Princeton, WV 24739. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated November 21, 2024, of record in the Clerk's Office. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Mercer County, in Princeton, West Virginia, on the following date:

23rd day of April, 2026
at 12:20 p.m.

The following described parcels situated on the waters of Laurel Creek, Plymouth District, Mercer County, West Virginia, and more particularly described as follows:

FIRST: All of a certain tract or parcel of land, situate in Mercer County, on the waters of Big Laurel Creek and being a part of two separate but contiguous tracts that is to say 46 acres is of the 89 acres conveyed by John Keatley and wife and 29 acres is out of the 77 ½ acre tract conveyed by H.F. Gore and wife, to Wm. R. Snider recorded in DEED Book No. 5 page 649 & 50, and Book No. 14 page 472 & 3, making 75 acres be the same more or less and is bounded as follows:

BEGINNING at a stake on the north bank of Big Laurel Creek and corner to G.W. Snider and with the same N. 42 E. 6 poles to a stake; thence N. 48 W. 28 poles to a stake by a fence thence N. 16 15 E. 24 poles to the mouth of a branch thence running up and with the several courses of said Branch to small spruce near said branch and corner to James R. Snider 3 3/8 acre tract and with the same reversing the course N. 61 W. 21 pole to a chestnut oak and maple on a cliff N. 64 30 W. 20 poles to a chestnut and chestnut oak on the cliff N. 83 W. 7 poles 12 links to a birch on the cliff N. 10 30 W. 13 poles to a birch between 2 rocks N. 7 15' E. 14 poles to a chestnut oak on the cliff, N. 28 30 E 16 poles to a small white oak thence N. 10 W. 58 poles crossing Bear Pen Branch to a large spruce pine and corner to William R. Snider and with the same down said Bear Pen Branch about 60 poles to a station in said branch thence N. 87 W. 28 poles to a bunch of sowerwoods by a fence thence S. 7 W. 23 poles 16 links to a white oak on a point N. 85 W. 37 poles crossing the road and follow to a chestnut stump on top of a ridge N. 74 30 W. 50 poles 10 links to a spruce pine on west bank of Keatleys spring branch thence down said _____ with its several courses and binding thereon to Big Laurel Creek thence up said Creek with its several courses and binding thereon to the BEGINNING. It is also understood that the said Wm. J. Snider is to have a pass-way on the present road up the creek, described in a deed by B.I. Snider from Dimantha Snider, et al, dated April 20, 1897, of record in said Clerk's Office in Deed Book No. 44, at Page 214.

SECOND: A certain tract and parcel of land situate in the County of Mercer and State of W.V. southwest of Pride bounded and described as follows:

BEGINNING at a large spruce pine and corner to Mary Keatley line thence running S. 88 W. passing a dogwood at 59 poles crossing the road 86 poles 135 poles to a spruce pine and hickory on the west bank; the Keatley spring branch, thence down said Branch S. 15 30 E. 16 poles S. 7 30 W. 14 poles S. 43 W. 9 poles S. 2 N. 5 poles 14 links to a spruce pine on the west side of said branch and corner to Henry Keatley thence S. 74 30 E. 50 poles 10 links to a chestnut stump on top of a ridge S. 85 E. 37 poles crossing a hollow and road to a white oak on a point No. 7 E. 13 poles 16 links to a bunch of sowerwoods by a fence thence S. 87 E. 28 poles to a station in the Bear Pen Branch thence up said branch about 60 poles to the BEGINNING and containing 43 ¼ acres more or less.

THIRD: That certain tract or parcel of land situate on the waters of Bear Pen Branch, in the said County of Mercer and State of West Virginia and bounded and described as follows:

BEGINNING at the Mary Keatley corner in the Bear Pen Branch and running with said line in a western direction S. 88 W. 18 poles to a chestnut stump in said line thence in a Southern direction 16 poles to a corner of a cliff marked X, thence in an Eastern direction 20 poles to a Chestnut near the Bear Pen Branch, thence in a Northeastern direction to the BEGINNING.

Containing 4 ½ acres more or less.

AND BEING the same property conveyed unto Anthony Scyphers by deed of Samuel M. Bowling, Ellis H. Bowling, Jr. and Marsha Bowling Hunt, dated September 21, 2009, to be forthwith recorded in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

All interests in certain lands, situate in Plymouth District, Mercer County, West Virginia, and bounded and described as follows:

FIRST: That certain parcel or boundary of land situate in said County and described as follows:

BEGINNING at a bunch of Alders on the bank of Laurel Creek, N. 8 decrees W. 1100 feet to a small white oak by the road side; thence N. 72 degrees E. with the road, 125 feet to a stone by the road side; thence S. 76 degrees E. 245 feet to a small white oak by the fence; thence S. 83 degrees 30 E. 32 poles to a small dogwood; thence S. 9 degrees to W.J. Snider line and with the W.J. Snider line to Laurel Creek; thence with Laurel Creek to the BEGINNING, and containing 20-7/8 acres, more or less.
SECOND: All that certain parcel or boundary of land, containing 50 acres, more or less, on the Waters of Big Laurel Creek, in said County and State, and described as follows:

BEGINNING in the division line between John Keatley and Levi Hearn, at or near a hickory and chestnut (marked) in the head of a hollow; thence with the line as aforesaid, S. 30 degrees W. about 144 poles to the head of Laurel Creek; thence up said creek with the several courses of same to the mouth of Keatley's Spring Branch, and up the same, and with its several courses to a line, as run for Asa Belcher, and with said line, S. 87 degrees W. about 70 poles to some chestnuts on a ridge; thence No. 43 degrees W. 78 poles to the BEGINNING.

And being the same property conveyed unto Anthony Scyphers by deed of E.E Carter, dated Oct. 29, 2009, to be recorded simultaneously in the Office of the Clerk of the County Commission of Mercer County, West Virginia.

This Conveyance is made and accepted subject to all mineral and mining rights and all reservations and restrictions heretofore granted or reserved by all predecessors in title, except any pertaining to race, creed or color.

TERMS OF SALE:

1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.

2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.

3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.

4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.

5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.

6)Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.

7)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
